
Raipur: The Chhattisgarh High Court has upheld a family court’s decision to grant a divorce to a couple on the basis of repeated insults by the wife, according to a media report. The court observed that the wife calling her husband “Paatlu Chuha (Pet Rat)” for obeying his parents could be considered a form of cruelty. A division bench of Justices Rajani Dubey and Amitendra Kishore Prasad was hearing the matter, which dismissed the woman’s plea against a family court order issued in 2019. It noted that the evidence substantiated the husband's claims of cruelty and desertion. Not only did the woman insult the husband by calling names, but she also pressured him to abandon his parents to live with her separately. In a ruling on September 3, the court said
that the wife's behaviour — including calling her husband a “paaltu chuha” (pet rat) for listening to his parents — amounted to mental cruelty, reported The Times of India. He also claimed that she tried to harm herself during pregnancy and often disrespected his parents.The court noted that the husband backed up his claims with text messages and testimony from family members. One of her messages said: “Leave your parents and stay with me.” The judges said that in Indian society, asking a spouse to abandon their parents causes mental cruelty.They also pointed out that the wife stayed away from her husband's home for most of their marriage, which met the legal definition of desertion. She had only briefly returned in 2011.The wife had asked the court to restore the marriage, but the judges rejected her request, saying her behaviour did not support it.In the end, the court granted the divorce and ordered the husband to pay Rs 5 lakh as permanent alimony (a one-time financial settlement).
