The Supreme Court dismissed her petition and suggested that her access to WhatsApp doesn't come under fundamental rights which is why a case cannot sustain against WhatsApp. While Dr Kundra argued that the access to WhatsApp is very important for her business to survive, the bench led by Justice Sanjiv Khanna came to a conclusion WhatsApp is a private firm and the users can not be bound by its terms of service. The court also asked the doctor in picture here to starting using a WhatsApp alternative like Arattai.
Why Court Said So?
The Supreme Court focused on the fact that access to any private digital platforms like WhatsApp doesn't come under the Constitution of India.
