New Delhi: A petition was filed in the Supreme Court today seeking initiation of contempt proceedings against Delhi Police, Centre, Metro and Railway authorities
for “willfull deliberate disobedience” of yesterday’s order by Chief Justice of India (CJI) Surya Kant -led Bench restraining “absolute prohibition” on metro trains and arrival of trains at Nizamuddin and New Delhi Railway stations. ahead of the Cockroach Janata Party' (CJP's) protest against Chief Election Commissioner Gyanesh Kumar. The plea filed by the main petitioner in the CJP protests case, Advocates Shailendra Mani Tripathi and Chand Qureshi. The contempt petition also says: “Pass an urgent ad-interim direction commanding the Respondents to immediately revoke all blanket prohibitory orders against Metro and Railway operations and enforce a strictly regulated, operational schedule with immediate public notice” Petition says: Prevent the contemnors from blatantly infringing the fundamental rights of the petitioner and the people of Delhi, in spite of the specific order in this regard. The contemnors issued officer orders and public notices that in view of the protest call given by different groups of people and the CJP, 57 stations of Delhi Metro will be closed for public use.” It adds: Notwithstanding the solemn judicial mandate and the assurance recorded before the Bench of Hon’ble the Chief Justice, the Contemnors have consciously maintained a blanket shutdown across transit corridors, persisted with unwarranted train cancellations, and failed to issue or publicize transparent traffic and transit advisories. This deliberate recalcitrance has severely crippled public life across the National Capital Territory, stranding D essential travelers, and amounts to an intentional attempt to bypass and undermine the authority and majesty of this Hon’ble Court. Hence, this petition."
What SC Had Said?
--Absolute prohibition on metro trains and arrival of trains at Nizamuddin and New Delhi railways stations appears to be an "overreach".
