Kolkata: The Calcutta High Court on Thursday strongly criticised the Election Commission for imposing restrictions on bike movement two days before the West
Bengal Assembly elections. Justice Krishna Rao said the poll panel appeared to be misusing its powers and causing inconvenience to ordinary people. Addressing the Election Commission's lawyer, Justice Rao said, "Show where such notifications are issued in other states. Just because the Election Commission has power doesn't mean anything can be done. Citizens are being harassed... You have a police administration and CCTV, so what's the need for this? Shut everything down. You've issued a notification. On what basis? Where is the precedent? Provide references. This is an unreasonable attempt to halt everything for so long." Also Read: EC's New Post Poll Guidelines For West Bengal Election The court asked the Election Commission to file an affidavit on Friday explaining why these restrictions were necessary. Justice Rao further said, "Why isn't your authority declaring an emergency? Declare an emergency two days prior and conduct the election. This implies the authorities' failure. Citizens' rights cannot be curtailed in this manner. Then ban cars, too. People can still cause trouble with bombs and arms." The judge also asked the Commission to provide data on how many cases involving bike gangs had been reported in the last five years.
What Is The Restriction?
The Election Commission had issued an order on Tuesday banning bike rallies two days before polling.
Under the rules, bikes can only be used between 6 AM and 6 PM during this period. No pillion rider will be allowed. On polling day too, bikes can be used only between 6 AM and 6 PM.
However, the restriction will not apply in cases such as medical emergencies, family emergencies, school-related work, social events, app-based cab services, and food delivery.
People seeking exemption for other reasons will need written permission from the local police station.
The EC's order was challenged in the Calcutta High Court on Wednesday. Justice Rao allowed the petition, and the matter was heard on Thursday.
The Election Commission will submit its response before the court on Friday.
