A Delhi court accepted the unconditional apology of a woman who faced perjury proceedings for concealing that she had already received part of the settlement amount in her divorce case. In an order, Judicial
Magistrate First Class (Mahila Court) Anam Rais Khan at Saket Court noted, “Complainant has tendered an unconditional apology to the court for her conduct of not disclosing the part settlement amount of Rs 10 lakh received… in the divorce proceedings and has undertaken not to repeat such conduct in future.”
The court said her statement had been recorded and found satisfactory and disposed of the case as settled.
Both parties told the court that their dispute had been resolved for a full and final settlement of Rs 21 lakh. The complainant, the ex-wife, had already received Rs 10 lakh as part of this settlement.
Earlier, the court had initiated criminal proceedings against her for allegedly concealing the Rs 10 lakh payment, observing that “any misuse of law meant for women’s protection has to be nipped in the bud.”
The woman also told the judge she wished to withdraw the domestic violence case she had lodged against her husband. The case was accordingly disposed of as settled. The court added that if the terms of settlement or her undertaking were not complied with, proceedings could be initiated under the Contempt of Courts Act, 1971.
