Sunjay Kapur’s Assets Case: In a big relief for actress Karisma Kapoor’s children, the Delhi High Court on Thursday ordered the freezing of foreign bank accounts linked to late industrialist Sunjay Kapur,
while granting interim protection over his estate.
The High Court, while allowing an interim injunction petition, also restrained the operation of cryptocurrency holdings and directed that the Rs 30,000 crore worth assets of Kapur, who died in London in June last year, be preserved amid a dispute between his third wife, Priya Sachdeva Kapur, and his children Kiaan and Samaira from his second marriage to actress Karisma Kapoor.
Delhi High Court Justice Jyoti Singh observed that the estate must not be dissipated during the pendency of the trial, noting that the proceedings may take time.
“The question whether the estate should be preserved—the answer is in the affirmative,” the court said, stressing that all legitimate concerns raised by the petitioners must be examined.
The High Court has also ordered status quo on Kapur’s assets and restrained the creation of any third-party rights. It also directed the parties to file detailed account statements before the court.
Kiaan and Samaira have accused Priya Kapur of forging a will attributed to Sunjay Kapur and of filing an incomplete list of his assets. They allege the list excludes expensive horses used for polo and luxury wristwatches from brands such as Audemars Piguet and Rolex.
Sunjay Kapur’s mother, Rani Kapur has also raised doubts over the validity and authenticity of the will.
Citing “suspicious circumstances,” the High Court restrained Priya Kapur from operating Sunjay Kapur’s bank accounts.
The onus, the court said, is on Priya Kapur to dispel suspicions surrounding the will’s authenticity. It added that Karisma Kapoor’s children had established a prima facie case and that it would be an “injustice” to them if no action were taken now and the will is eventually proven to be fake.
