The Court's Inquiry
A Lahore sessions court is actively involved in a case concerning Sarabjit Kaur, an Indian citizen, and Nasir Hussain, a resident of Pakistan. The court issued
notices to the Director and Investigation Officer of the FIA’s Immigration Wing, ordering a report on the allegations against Kaur. These allegations include her alleged illegal overstay since November 13, 2025, and the purported violation of visa conditions, which come under the Foreigners Act. The court has requested a detailed account of the events, especially regarding Kaur's prolonged stay in Pakistan, exceeding the permitted period, and also the role that Hussain played in this situation. The legal proceedings aim to establish the facts surrounding Kaur's presence in Pakistan beyond her visa's validity.
Pilgrimage to Marriage
Sarabjit Kaur's journey to Pakistan began as part of a group of approximately 2,000 Sikh pilgrims who entered the country via the Wagah border in November. The primary intention was to participate in religious festivities, a common occurrence for Sikh pilgrims. However, unlike the majority of the pilgrims who returned to India after a brief stay, Kaur remained in Pakistan. Reports suggest that she married Nasir Hussain, a resident of Sheikhupura district, which is around 50 kilometers from Lahore. This marriage occurred shortly after her arrival, significantly altering her initial travel plan and setting the stage for the legal issues she now faces in Pakistan.
Allegations and Violations
The central accusations against Sarabjit Kaur involve violations of immigration laws, specifically relating to her visa and extended stay. According to the petition, she entered Pakistan on November 4, 2025, as part of a group attending celebrations marking the birth anniversary of Guru Nanak. Her pilgrimage visa was expected to expire on November 13, 2025. However, she did not return to India with the rest of the group. The petition further alleges that she left Gurudwara Nankana Sahib and, along with Hussain, proceeded to marry. The petition also claims that Hussain aided and abetted her by providing assistance, shelter, and transportation, thereby facilitating her extended stay in the country, which is a breach of immigration laws.
Legal Proceedings Emerge
The legal implications of Kaur's actions have led to a case in the Lahore sessions court. The court's request for a report from the FIA's Immigration Wing indicates a serious examination of the allegations. The authorities have been asked to provide details concerning Kaur’s alleged illegal overstay, the purported violation of visa conditions under the Foreigners Act, and Hussain’s alleged role in aiding and abetting the offence. The situation has been further complicated by prior involvement with the Lahore High Court, which is reported to have instructed authorities to avoid harassing the couple. The final hearing of the case has been set for January 30, signaling an ongoing legal process to determine the validity of the claims and the consequences for the individuals involved.
