The legal proceedings initiated by KVN Productions against the Central Board of Film Certification (CBFC) have reached a turning point. The production
house, behind actor Vijay's film 'Jana Nayagan,' has officially decided to retract the writ petition it had filed in the Madras High Court. This significant development was communicated to the court registry by the counsel representing KVN Productions on a Monday. The intention behind this move is to discontinue the protracted legal dispute concerning the film's certification. Attorney Vijayan Subramanian, acting on behalf of KVN Productions, confirmed that the ultimate wish of actor Vijay is to have the petition withdrawn. The matter was slated to be brought before Justice PD Asha on Tuesday (February 10) to secure formal permission for this withdrawal, signaling an end to the courtroom confrontation and a shift in strategy for the film's release process.
Shifting Strategy
In a strategic pivot, the makers of 'Jana Nayagan' have chosen a different path to secure a release for their film, opting out of further legal entanglements. A letter submitted to the Madras High Court by the producer clearly articulates this new direction, stating a preference to present the movie before the CBFC’s Revising Committee. This decision suggests a willingness to engage with the certification body's internal review process rather than continue the often lengthy and unpredictable judicial route. 'Jana Nayagan,' directed by H. Vinoth, had its initial release date set for January 9. The film boasts a prominent cast including Pooja Hegde, Bobby Deol, Mamitha Baiju, Gautham Vasudev Menon, Priyamani, and Narain. Its release was particularly anticipated as it was to be Vijay’s final cinematic offering before his political foray with the Tamilaga Vettri Kazhagam (TVK) party in the Tamil Nadu elections. The referral of the film to a revising committee by the CBFC, which occurred shortly before its scheduled release, was the catalyst for the initial High Court challenge.
Certification Hurdles
The path to certification for 'Jana Nayagan' has been fraught with challenges, leading to the current legal and strategic shifts. The film's journey took a complex turn when, just days prior to its intended release, the CBFC decided to refer it to a revising committee. This action prompted KVN Productions to seek recourse through the Madras High Court, contesting the board's decision. Previously, the High Court had delivered a ruling in favor of the producers, directing the CBFC to grant a U/A certificate after specific modifications were made to the film. Despite this earlier judicial intervention, the movie has yet to receive its official certification. Neither the production house nor the CBFC has released any official statements regarding the ongoing situation or the reasons behind the delay. Adding another layer to the complexity, the CBFC had also filed a caveat before the Supreme Court, emphasizing their right to be heard before any order regarding the film's release is passed.
