In a decisive move, the Supreme Court of India has transferred the investigation of the Malda judicial officers' gherao incident to the National Investigation
Agency (NIA). A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and Vipul M Pancholi invoked their powers under Article 142 of the Constitution to ensure the NIA takes over the probe, even if the initial offenses wouldn't typically fall under the agency's purview. This action was prompted by the state administration's alleged failure to protect judicial officers performing their duties related to the Special Intensive Revision (SIR) exercise for electoral rolls. The court's intervention underscores the gravity of the situation and the necessity for a comprehensive, unbiased inquiry into the breakdown of law and order.
NIA Registers Cases
Acting swiftly on the apex court's mandate, the NIA has officially registered 12 cases in connection with the April 1st incident in Malda, West Bengal. Specifically, the agency has re-registered seven First Information Reports (FIRs) from the Mothabari police station and five FIRs from the Kaliachak police station. These FIRs pertain to the alleged gherao and detention of judicial officers who were stationed in the Kaliachak-II block office and Mothabari Chowrangi areas to conduct the SIR exercise. Investigation teams from the NIA have already been dispatched to Malda to commence a thorough and in-depth inquiry into the events that transpired, with a focus on uncovering the full scope of the incident and identifying all individuals involved.
Probe for Masterminds
The ongoing investigation by the NIA is not merely focused on apprehending those directly involved in the gherao but also on meticulously uncovering the individuals who orchestrated the entire operation. Investigators are actively seeking to identify the mastermind behind the violence and the detention of the judicial officers. Thus far, 35 arrests have been made in connection with the incident. However, the paramount objective of the NIA's probe is to understand the planning and execution of the attack, ensuring that those who conceived and facilitated such a serious breach of security and law are brought to justice, thereby preventing future occurrences.
