Illegal Surcharges Identified
The Central Consumer Protection Authority (CCPA) has recently issued a stern warning to hotels and restaurants across India. They have identified a growing
trend where establishments are adding unauthorized charges, such as 'LPG charges,' 'gas surcharges,' or 'fuel cost recovery,' to the final food bills. This practice is considered an unfair trade practice and is in violation of consumer protection laws. The CCPA's advisory explicitly states that such additional levies are not permissible and will invite strict action if found. This move by the authority aims to protect consumers from being misled and burdened with extra costs that are not part of the advertised menu prices or applicable taxes.
Cost Inclusion Mandate
According to the CCPA's directive, businesses like hotels and restaurants are expected to incorporate all operational expenses, including the cost of fuel, LPG, electricity, and other essential running costs, directly into the pricing of their menu items. This means that the price displayed on the menu should be the final price consumers are expected to pay, with the exception of legally applicable taxes. The authority emphasizes that consumers should not be coerced into paying any additional amounts that are not voluntarily agreed upon. The intent is to ensure transparency in billing and prevent restaurants from using these hidden charges as a means to bypass existing regulations on service charges.
Consumer Recourse Options
Consumers who encounter such illegitimate charges on their bills have several avenues for recourse. The CCPA advises diners to first request the hotel or restaurant to remove the erroneous charge from their bill. If the establishment refuses or the practice persists, consumers can lodge a formal complaint. This can be done by calling the National Consumer Helpline at 1915 or by using its dedicated app. For more serious grievances, consumers also have the option to file a complaint directly with the appropriate consumer commission through the e-Jagriti portal, ensuring their rights are protected and promoting fair business practices within the hospitality sector.
