Oracle has voluntarily dropped its lawsuit against Wisconsin’s utility regulator, the Public Service Commission (PSC), concerning new credit rating requirements for data center developers. The tech giant had filed the lawsuit in Ozaukee County Circuit
Court nearly two months prior, challenging rules that mandate data center operators maintain an A- credit rating or post significant collateral to secure electricity. Oracle, a co-developer of a large data center campus in Port Washington, argued these requirements were overly stringent and could deter other companies from investing in Wisconsin. The PSC's rules aim to protect other ratepayers from potential financial burdens if a data center developer becomes insolvent, especially given the massive power needs of these facilities. The Port Washington facility, co-developed by Oracle, OpenAI, and Vantage, is projected to require 1.3 gigawatts of electrical generation capacity in its initial phase, equivalent to powering approximately one million Wisconsin homes. Oracle's credit rating, which was BBB when the PSC approved the standards and later lowered to BBB- by S&P Global Ratings, falls below the A- threshold, potentially costing the company over $100 million annually in financial security payments.

Madison Gas and Electric is awaiting PSC input on its own data center rate structure, which also proposes collateral requirements for developers with credit ratings below A-, albeit with varying collateral amounts based on the specific rating.
