What's Happening?
The city of Wheeling and Silicon Foundry Energy LLC have reached a binding memorandum of understanding (MOU) that stipulates the company will not develop a high-impact data center in Warwood. This agreement is expected to be approved by the Wheeling City
Council during its upcoming meeting. The MOU addresses community concerns regarding potential noise, water pollution, and increased electric bills associated with large-scale data centers. While initial information from Silicon Foundry Energy suggested plans for a 100-megawatt facility, company officials have since clarified that this is not their objective. The agreement is designed to be a legally binding contract ensuring the Warwood operation remains below the threshold of a high-impact data center, which is defined as having a critical information technology load of 90 megawatts or higher. Wheeling City Manager Robert Herron stated that the agreement provides certainty to the community and enables the city to potentially include the area in a Tax Increment Financing (TIF) District.

This agreement is significant for the city of Wheeling as it allows for local governmental authority over the Silicon Foundry Energy operation, which would otherwise be largely regulated by the state under HB 2014 if it were a high-impact data center. By preventing the development of a high-impact facility, the city retains the ability to establish and maintain a TIF District in Warwood, including the former Centre Foundry property. This TIF District could provide a crucial funding mechanism for public improvements, as municipalities are barred from using TIF Districts where high-impact data centers operate. The MOU also ensures that Silicon Foundry Energy would be responsible for compensating the city for any lost tax revenues if an expansion were to negatively impact the TIF District. If approved, the MOU will be signed by Wheeling City Manager Robert Herron and Andrii Garanin, chief energy and infrastructure officer for Silicon Foundry Energy LLC. Following the execution of the MOU, the city intends to establish or extend a TIF District into Warwood to include the former Centre Foundry property. This will allow the city to apply tax increment revenues toward public improvements benefiting the TIF District. Silicon Foundry Energy is expected to coordinate with the city on infrastructure and utility connections, as outlined in the agreement. The binding nature of the MOU provides a clear framework for future development and ensures that the company's operations remain within the agreed-upon parameters, addressing ongoing community concerns.
