What's Happening?
The National Oceanic and Atmospheric Administration’s National Geodetic Survey (NGS) is modernizing the National Spatial Reference System (NSRS), the federal framework for coordinates and elevations across the United States. This significant update, scheduled
for 2026, will replace existing systems like NAD 83 and NAVD 88 with new terrestrial reference frames, including NATRF2022 for North America, and a new gravity-based vertical datum, NAPGD2022. The change is driven by technological advancements, as the older systems were developed using less precise surveying methods compared to today's satellite positioning and gravity measurements. The current NAD 83 is approximately 2.2 meters non-geocentric, and NAVD 88 has a significant vertical bias. The modernized NSRS will rely heavily on GNSS observations, continuously operating reference stations, Earth’s center of mass, and gravity measurements, also incorporating tectonic plate motion and time-dependent positioning.
Why It's Important?
This modernization will have a profound impact on the U.S. real estate sector and any industry relying on precise geospatial data. While land itself will not move, the coordinates used to describe its location will shift by 1 to 4 meters horizontally and up to 1 meter vertically. This seemingly small change can create significant discrepancies in land surveys, site plans, floodplain determinations, easements, utility locations, and GIS databases. For commercial real estate, misaligned datasets could lead to legal disputes, construction delays, and financial losses if not properly managed. Developers, owners, and operators will need to ensure that all new and legacy spatial information is correctly transformed and documented to avoid issues during property transactions, development projects, and litigation. The transition also highlights a potential conflict between consumer privacy laws, such as Maryland's Online Data Privacy Act of 2024, which bans the sale of precise GPS data, and the need for accurate location information.

Real estate professionals are advised to begin planning for the 2026 modernization now. NGS has set January 13, 2027, as the deadline for submitting geodetic survey projects under the current NSRS. Businesses should proactively identify existing ALTA/NSPS land surveys, boundary and topographic surveys, civil engineering plans, utility mapping, and other geospatial data. It will be crucial to ask surveyors and engineers about the datum and coordinate reference system used for both new work and legacy data. Purchase agreements, development agreements, and other legal documents should specify the applicable datum and coordinate reference system. While not everything will require resurveying, the transformation of legacy data into the modernized system must be understood and meticulously documented. Companies that prepare early will be better positioned to avoid surprises and ensure seamless operations during and after the transition.
