Brendan Clegg has joined Arnold & Porter's Financial Services practice as a partner, based in the firm's Washington, D.C. office. Clegg brings nearly 15 years of experience in both the public and private sectors, including a tenure as enforcement counsel
at the Office of the Comptroller of the Currency (OCC). In his new role, he will represent national and state-chartered banks and other financial services providers on a range of regulatory, transactional, licensing, and enforcement matters. His expertise includes advising clients on issues before various federal agencies such as the OCC, Federal Deposit Insurance Corporation, Federal Reserve Board, Consumer Financial Protection Bureau, Financial Crimes Enforcement Network, and National Credit Union Administration, as well as state banking regulators.
Why It's Important?
Clegg's addition to Arnold & Porter's Financial Services practice is significant for the U.S. financial industry, particularly for institutions navigating complex regulatory landscapes. His extensive experience, especially his background as enforcement counsel at the OCC, provides him with a deep understanding of regulatory expectations and enforcement mechanisms. This expertise will be invaluable to banks and financial services providers seeking guidance on compliance, risk management, and corporate governance in an increasingly stringent regulatory environment. The move reflects a broader trend of law firms bolstering their financial services practices with seasoned professionals who have direct experience within regulatory bodies, enabling them to offer more nuanced and effective counsel to clients facing supervisory findings, regulatory examinations, and enforcement actions. This strengthens the legal support available to financial institutions, helping them to maintain operational integrity and navigate potential legal challenges.
What's Next?
Brendan Clegg will immediately begin advising Arnold & Porter's clients on a variety of financial regulatory matters. His focus will include assisting clients with supervisory findings, navigating regulatory examinations, and counseling on consumer compliance, anti-money laundering, safety and soundness, and corporate governance issues. Given the evolving regulatory landscape in the U.S. financial sector, his expertise will be particularly relevant as institutions adapt to new rules and increased scrutiny. His presence at Arnold & Porter is expected to enhance the firm's capacity to handle complex financial services cases and provide strategic advice to its banking and financial institution clients, potentially influencing how these entities approach their regulatory obligations and transactional activities.
Beyond the Headlines
The recruitment of former regulatory officials like Brendan Clegg by private law firms highlights a critical aspect of the U.S. regulatory ecosystem: the revolving door between government service and private practice. While this practice provides firms with invaluable insider knowledge and expertise, it also raises questions about potential conflicts of interest and the fairness of the regulatory process. However, it also ensures that the private sector benefits from a deep understanding of regulatory intent and practical application, which can lead to more effective compliance strategies for financial institutions. Clegg's move underscores the high demand for specialized legal talent capable of bridging the gap between complex financial regulations and the operational realities of banks, ultimately contributing to a more informed and compliant financial industry.
