The U.S. cosmetic industry is undergoing a significant regulatory shift following the enactment of the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). This new legislation substantially strengthens federal oversight, moving beyond the traditional
framework primarily based on the Federal Food, Drug, and Cosmetic Act (FD&C Act) and the Fair Packaging and Labeling Act (FPLA). Previously, cosmetic registration was voluntary, and pre-market approval was not required. MoCRA introduces a range of mandatory compliance obligations, including facility registration, product listing, safety substantiation, and serious adverse event reporting. Companies marketing or exporting cosmetics to the U.S. must now adhere to both the longstanding federal statutes and the new requirements set forth by MoCRA. The U.S. Food and Drug Administration (FDA) is the primary federal authority responsible for enforcing these regulations, developing guidance, operating electronic submission portals, and conducting post-market surveillance and enforcement actions. MoCRA also grants the FDA mandatory recall authority under specific statutory conditions.

Product listings must be submitted for each cosmetic product marketed in the U.S., with initial listings for products marketed after December 29, 2022, due within 120 days of entering interstate commerce, and annual updates thereafter. Responsible persons must also establish systems for safety substantiation, serious adverse event reporting within 15 business days, and maintaining related records for six years. Additionally, cosmetic labels must display U.S. contact information for adverse event reports by December 29, 2024. The FDA will continue to develop and implement regulations, including those concerning Good Manufacturing Practices (GMPs), fragrance allergen labeling, and standardized testing methods for asbestos in talc-containing cosmetics. Small businesses with annual gross sales under $1,000,000 are exempt from facility registration and product listing, with specific exceptions for certain product types.
