China is preparing to upgrade its power battery recycling regulations, moving from departmental rules to administrative regulations at the State Council level. This legislative enhancement is in response to an anticipated surge in spent power batteries,
with projections indicating an annual generation volume exceeding 1 million tons by 2030. Vice Minister Xin Guobin of the Ministry of Industry and Information Technology (MIIT) announced that the government will study and draft new administrative regulations during the 'Fifteenth Five-Year Plan' period (2026–2030). The current regulatory framework, the Interim Measures for the Management of Recycling and Comprehensive Utilization of Spent Power Batteries from New Energy Vehicles, which came into effect on April 1, 2026, is deemed insufficient to handle the growing compliance pressures and market challenges. The new regulations aim to strengthen the enforceability of extended producer responsibility (EPR) obligations, introduce a digital identity card management system for power batteries to ensure traceability, and intensify joint law enforcement operations across multiple departments.
