What's Happening?
Skadden, Arps, Slate, Meagher & Flom LLP has announced the addition of Andrew Dean and Christopher Mulligan as partners. Both individuals previously held leadership positions at the U.S. Securities and Exchange Commission (SEC). Mr. Dean, formerly co-head
of the Asset Management Unit in the SEC’s Division of Enforcement, joins Skadden’s New York office in the White Collar Defense and Investigations Group. Mr. Mulligan, a former senior advisor in the SEC’s Division of Examinations and co-coordinator of the agency’s Private Funds Specialized Working Group, joins the firm’s Washington, D.C. office as part of the Investment Management Group. Their appointments are intended to bolster Skadden's SEC regulatory and enforcement capabilities, particularly in advising asset managers, investment advisers, registered funds, and private funds on regulatory, enforcement, and compliance matters. This move follows the recent addition of other investment management partners, including Robert Griffin, Kapil Vishnu Pandit, and Skye Smith, in June.
Why It's Important?
The integration of former SEC leaders like Mr. Dean and Mr. Mulligan significantly enhances Skadden's ability to navigate the complex and evolving regulatory landscape for asset management clients. Their combined experience offers clients a comprehensive 360-degree view of the SEC's priorities and approach, from examinations and compliance to investigations and enforcement. This is crucial for financial services clients who face increasing scrutiny and regulatory challenges. The firm's expanded private capital advisory team will provide integrated advice across the entire lifecycle of fund formation and structuring, which is vital for private equity fund sponsors, hedge funds, and other regulated entities. This strategic growth positions Skadden to better serve clients in anticipating regulatory developments and addressing significant regulatory challenges, potentially reducing legal and financial risks for these entities.
What's Next?
The enhanced team at Skadden is expected to provide more robust and proactive guidance to asset management clients, helping them to stay ahead of the SEC’s evolving priorities. This could lead to a more streamlined approach for clients in managing examinations, ensuring compliance, and handling enforcement matters. The firm's continued investment in the private capital arena suggests a focus on expanding its influence and service offerings in this sector. Clients can anticipate more comprehensive and integrated legal strategies, potentially leading to improved regulatory outcomes and greater operational efficiency in a highly regulated industry. The firm's ability to offer insights directly from former SEC officials will likely be a key differentiator in attracting and retaining high-profile clients in the asset management space.
