The Food Safety and Standards Authority of India (FSSAI) has issued a directive requiring all products currently labeled as 'energy drinks' to be re-labeled as 'caffeinated beverages.' This regulatory change stems from the FSSAI's stance that 'energy drink'
is not a legally recognized product name under Indian food laws, despite existing as a food category. Brands are also prohibited from making functional or therapeutic claims, such as 'boosting energy' or 'aiding general weakness,' unless backed by valid scientific data and laboratory testing. The FSSAI has set a 90-day deadline for compliance, which former FSSAI official Pradip Chakraborty believes is insufficient given the significant costs involved in label preparation. Non-compliant products face penalties, including seizure and destruction, and fines up to INR200,000 (approximately US$2,096) for failing to comply with the Food Safety Act. Companies making false or misleading advertisements could face fines up to INR1 million (approximately US$10,476).
