court in Kerala has directed the police to register an FIR based on actor Ansiba Hassan's complaint against fellow actor Tini Tom, providing significant relief to the Drishyam star after the police had earlier declined to initiate criminal proceedings.As per a report in Live Law, the Judicial First Class Magistrate VIII, Ernakulam, on June 30 ordered the Station House Officer of the Kadavanthra Police Station to investigate Ansiba Hassan's allegations, observing that a prima facie cognisable offence was made out and warranted a detailed probe.
Magistrate Kavya Soman passed the order on a private complaint filed by Hassan after she approached the court alleging police inaction. Hassan had accused Tini Tom of making derogatory and offensive remarks against her, including referring to her as a "jihadi" and using phrases such as "double-daddy syndrome" and "issue with DNA."While considering the matter, the court examined the police report, which acknowledged that Tom had used the alleged expressions but concluded that they were made in a "playful" manner and without criminal intent.The Magistrate, however, found the report inadequate and said the question of criminal intent could only be determined after a thorough investigation."The report itself states that it has been revealed that the respondent had stated words like double-daddy syndrome, issue with DNA, jihadi, etc. against the complainant. According to the report, the respondent had used such words in a playful meaning and does not have any criminal intent. This shows that the report is incomplete and cannot be fully relied on to proceed further," the court observed.
The order further stated that only a detailed investigation and collection of evidence would determine whether the alleged remarks amounted to criminal offences. Holding that there was a prima facie case, the Magistrate forwarded the complaint to the Kadavanthra Police Station under Section 173(5) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) for investigation.According to the order, the complaint invokes offences punishable under Sections 74, 75(iv), 79, 299 and 302 of the Bharatiya Nyaya Sanhita (BNS), along with Section 119(a) of the Kerala Police Act.The court also took note of witness statements recorded during the preliminary inquiry. Actor Neena Kurup reportedly told the police that Tini Tom had made similar remarks about Ansiba Hassan at the AMMA office in Kaloor. Kurup further stated that AMMA president Swetha Menon had informed her that Tom had made comparable comments to her as well.With the Magistrate's order, the police are now required to register an FIR and carry out a detailed investigation into the allegations against Tini Tom.
