Yes, You Can Deduct These Bills
The Income Tax Act allows freelancers to deduct expenses that are incurred 'wholly and exclusively' for business purposes. Your income is taxed under 'Profits and Gains of Business or Profession', which means legitimate costs of earning that income can
be subtracted before calculating tax. Since a phone and internet connection are essential for nearly every modern freelancer—for client calls, research, marketing, and delivering work—they fall squarely into this category. The key is proving that the expense was for your work.
The Challenge: Mixed Personal and Business Use
Here's the catch: you can't claim 100% of your personal mobile or home internet bill if you also use it for watching movies, scrolling through social media, or calling family. The tax law requires you to separate the business portion from the personal portion. Claiming the entire bill without justification is a red flag and won't hold up if the tax department asks questions. The solution is to calculate a reasonable 'business-use percentage'.
Calculating Your Business-Use Percentage
There is no single formula mandated by the tax department, but you must use a logical and consistent method that you can defend if needed. One common approach is to track your usage for a representative period, like one month. For your phone, you could analyse your call log or estimate the hours spent on business calls versus personal ones. For internet, you could calculate the number of hours you work each day as a percentage of the total hours you use the internet. For example, if you work 8 hours a day and are online for personal use for another 4 hours, a 66% business use claim could be considered reasonable. Whatever method you choose, document it clearly.
A Practical Example
Let's say your monthly internet bill is ₹1,000 and your phone bill is ₹800. After tracking your usage, you determine that your internet is used 60% for work and your phone is used 40% for business. Your deductible expense for the month would be: (₹1,000 x 60%) + (₹800 x 40%) = ₹600 + ₹320 = ₹920. Over a year, this amounts to a deduction of ₹11,040. If you are in the 30% tax bracket, this simple calculation saves you over ₹3,300 in taxes.
Keep Your Records Straight
The most important part of claiming deductions is documentation. You must keep all the original bills and invoices for your phone and internet services. It is also highly recommended to maintain a simple log or a note explaining how you arrived at your business-use percentage. This could be a simple spreadsheet. Should you ever face a tax scrutiny, these records are your proof that the claims were made in good faith and based on a reasonable calculation. Always pay these bills through banking channels like UPI, net banking, or cards, as bank statements provide strong proof of payment.
A Note on the Presumptive Tax Scheme
Many freelancers in India opt for the Presumptive Taxation Scheme under Section 44ADA. This scheme allows you to declare 50% of your gross annual receipts as your income, with the other 50% presumed to be your expenses. If you choose this scheme, you cannot claim individual expenses like phone and internet bills separately, as they are considered to be covered within that 50% lump-sum deduction. This scheme is simpler, but if your actual business expenses are more than 50% of your income, you might save more tax by declaring actual profits and claiming each expense individually.
