The EU's New Transparency Mandate
As of August 2, 2026, a pivotal part of the European Union's landmark AI Act is now in effect. These new rules, specifically under Article 50, impose transparency obligations on companies that develop or deploy AI systems within the vast EU market. The core
requirement is that content generated or manipulated by AI—including images, videos, audio, and text—must be clearly identifiable as artificial. This means providers of generative AI tools must embed machine-readable markers into their outputs, while those publishing certain types of synthetic content, like deepfakes, must add visible labels for the audience. The move isn't just a suggestion; non-compliance can lead to steep fines of up to €15 million or 3% of a company's global annual turnover, making it a significant new cost of doing business in Europe.
Defining Synthetic Reality
So, what exactly is 'synthetic media'? The term covers a wide spectrum of content created or significantly altered by artificial intelligence. At the most discussed end are 'deepfakes'—hyper-realistic videos or audio clips that can make people appear to say or do things they never did. But the scope is much broader, including photorealistic images generated from a text prompt, AI-composed music, and even articles written entirely by large language models on matters of public interest without human review. The EU's rules are designed to address content that could be deceptive. Routine photo editing, like colour correction or resizing, is generally not included. The line is crossed when AI is used to create or fundamentally alter the reality a piece of content purports to show, moving beyond enhancement into fabrication.
The Fight Against Digital Deception
The primary argument for these labels is the fight to preserve trust and combat misinformation in the digital age. As AI tools become more accessible, the volume of realistic but fake content has exploded, creating fertile ground for everything from political disinformation campaigns to sophisticated financial scams. Proponents argue that clear labels empower users, giving them the necessary context to critically evaluate the media they consume. It’s a matter of both consumer and democracy protection. By making AI's hand visible, the rules aim to disrupt the business model of bad actors who rely on deception and restore a baseline level of authenticity to the online world, ensuring users know when they are interacting with a machine versus a person, or viewing a fabricated image versus a real photograph.
Is a Simple Label Enough?
Despite the strong case, implementing a global labeling standard faces significant hurdles. A major technical challenge is that digital markers, like metadata or watermarks, can often be stripped or lost as files are compressed, converted, or shared across different platforms. This creates a chain of custody problem where a labeled file can become unlabeled downstream. Companies worldwide that want access to the EU's consumers must comply, which often leads them to adopt the same standards for all their operations. This is particularly relevant for India, which is actively working to regulate AI-generated content. Recent amendments to India's IT Rules have also mandated the clear labeling of synthetic media and imposed rapid takedown times for unlawful content, showing a parallel focus on transparency and accountability.
