The New Rules for Crypto Exchanges
Achieving FIU compliance is not a one-time task; it's an ongoing commitment. To operate legally in India, exchanges must register with FIU-IND. Beyond registration, they have several key obligations. First is robust Customer Due Diligence, widely known as Know Your Customer (KYC). This isn't just about collecting a PAN card anymore. Updated 2026 guidelines mandate sophisticated checks, including live selfie authentication and capturing geographic data to prevent fraud. Second, exchanges must monitor all transactions to detect and report suspicious activities to the FIU. Third, they must comply with the 'Travel Rule,' which requires them to share information about the originator and beneficiary of a crypto transfer, much like a wire transfer. Finally, transactions involving privacy-enhancing coins or mixing services are now deemed unacceptably high-risk.

In early 2024, show-cause notices were issued to several major global exchanges for not complying with PMLA norms, leading to their URLs being blocked for Indian users. More recently, in September 2026, the FIU took similar action against another 15 offshore platforms, making it clear that serving Indian users means following Indian laws, regardless of where the company is based. This crackdown on non-compliant entities serves as a strong incentive for platforms to register and adhere to the rules, creating a more structured and predictable environment for investors. It signals the end of the 'Wild West' era and the beginning of a more regulated ecosystem.
So, Is Your Crypto Actually Safer?
This is the most important question for any investor. The answer is nuanced. FIU compliance significantly enhances the safety of the crypto ecosystem from a legal and anti-crime perspective. A compliant exchange is less likely to be used for illicit activities, less likely to face a sudden regulatory shutdown, and generally operates with greater transparency. However, it's crucial to understand what FIU compliance is not. It is not a government license or an endorsement of an exchange's business practices.
