The Most Important Check: FIU-IND Registration
In India, the regulatory landscape for Virtual Digital Assets (VDAs) has solidified around one core requirement: registration with the Financial Intelligence Unit of India (FIU-IND). Since March 2023, all entities dealing in VDAs, including exchanges,
wallet providers, and custodians, must register with the FIU and operate as 'reporting entities' under the Prevention of Money Laundering Act (PMLA). This is not optional. For an investor, this is the first and most crucial check. An exchange that is not registered with the FIU-IND is operating outside the law. Authorities have actively blocked access to unregistered offshore platforms, making FIU registration a clear line between a compliant operator and a risky one.
Robust KYC is a Sign of a Healthy Platform
If an exchange lets you sign up and trade anonymously or with minimal details, consider it a major red flag. Compliant exchanges are mandated to perform thorough Know Your Customer (KYC) checks. As of January 2026, these rules have become even stricter. A compliant platform will require government-issued photo ID (like a PAN card or Aadhaar), verify it with a live selfie using liveness detection technology, and confirm your mobile number and email via OTP. They will also verify your bank account using a 'penny drop' test, where a small amount is sent to confirm ownership. This rigorous process protects the entire ecosystem from fraudulent accounts and illicit activities.
Anti-Money Laundering (AML) and Transaction Monitoring
Beyond onboarding, compliant exchanges have a legal duty to monitor transactions to prevent money laundering and terrorism financing. They must maintain records of all transactions for at least five years. This includes flagging and reporting suspicious activities to the authorities. Some exchanges also explicitly block the use of privacy coins or mixing services designed to obscure the flow of funds. While this might seem like a backend process, it's vital for user protection. It means the platform is actively working to keep bad actors out, which reduces the overall risk of the exchange being used for criminal purposes and facing regulatory shutdown.
Clear Support for Tax Compliance
India has a clear, albeit strict, tax regime for VDAs: a 30% tax on gains and a 1% Tax Deducted at Source (TDS) on most transactions. A responsible and compliant exchange will not ignore this. Instead, it will provide you with the tools to meet your obligations. Look for platforms that offer detailed transaction histories and annual statements that you can use for tax filing. Since April 2026, exchanges are required to share transaction data directly with the Income Tax Department, facing penalties for misreporting. An exchange that makes this process transparent and provides you with accurate records demonstrates its commitment to long-term, lawful operation in India.
Data Security and Physical Presence
Compliance extends to how a platform handles your data. A reputable exchange will have a clear privacy policy and robust security features like two-factor authentication (2FA) and cold storage for the majority of user funds. Furthermore, under the FIU-IND framework, registered entities must appoint a Designated Director and a Principal Officer based in India who are responsible for compliance. This ensures there is local accountability. While many global exchanges serve Indian users, those that are properly registered with the FIU-IND and have a designated local presence are demonstrating a higher level of commitment to the Indian market and its regulations.
