New Delhi: The Central Bureau of Investigation on Monday filed a chargesheet in the Twisha Sharma death case. The chargesheet has been filed against the deceased’s
mother-in-law Giribala Singh and her husband, Samarth Singh. Both of them have been charged with dowry harassment and abetment to suicide.
Twisha Sharma was found dead at her husband’s home in Bhopal on May 12. The 33-year-old had been married for just 5 months, when she was found dead, hanging at her in-laws house.
The family of the victim alleged that she was being tortured for dowry. According to sources, quoted by NDTV the CBI’s 636-page chargesheet has charged the mother-son duo under relevant sections of the anti-dowry act, matrimonial cruelty, abetment to suicide and acts done with common criminal intention.
Meanwhile, Twisha’s family had also alleged that she was being both mentally and physically tortured. They said that after her death, her mother-in-law who is a retired judge and her husband Samarth, who is a lawyer tried to influence the investigation and tried to destroy evidence.
An FIR was filed in the case and a search began for Samarth Singh. He was initially absconding but was finally arrested on May 22 from Jabalpur.
Later the case was handed over to CBI and Samarth Singh was taken into custody. The CBI began analysing his activities on the day of Twisha’s death. They also analysed his phone details. Later they arrested Giribala Singh, his mother.
The CBI also recreated the scene of the death, taking with them a dummy to the house where Twisha was found dead. The woman was found hanging with a gymnastics belt around her neck. The family members had then brought down the body and taken her to hospital. The CBI recreated this scene with a dummy and Giribala Singh and Samarth Singh.
The post mortem report of Twisha, revealed that there were 6 injuries on her body and the cause of death was hanging. This played an important role in the case.
The initial FIR filed by the family of the woman ,mentioned Sections 80(2), 85, and 3(5) of the Bharatiya Nyaya Sanhita, along with Sections 3 and 4 of the Dowry Prohibition Act. Now the CBI’s chargesheet also includes Section 108 of the BNS. This section pertains to abetment to suicide.
Meanwhile about the other Sections of the law in the case, Section 80(2) pertains to dowry death, Section 85 relates to cruelty inflicted upon a woman by her husband or his relatives, while Section 3(5) deals with acts committed with the common criminal intention of multiple individuals.
