A Portland law firm has reached a second multi-million-dollar judgment against Topgolf after a woman was injured at one of the entertainment venues.
The latest stems from a 2023 incident in which a woman got a huge gash in her head after being hit by a golf club that came out of a man's hands during his swing.
The law firm Smith Foster King filed a negligence lawsuit in federal court in Portland in early 2025. The firm announced the settlement this week, but the injured woman asked that the specific amount of money that she was awarded not be made public. Court records only indicate a settlement was reached, according to Oregonlive.com.

The woman, Kendal Spencer, was at Topgolf with friends in June of 2023 and, at the time of the incident, was sitting
on a couch in the bay they had reserved. The golf club that flew out of a golfer's hands came from two bays away.
Spencer had to take an ambulance to the ER, where she got nine staples in her scalp. In the lawsuit, she claimed she was diagnosed with a traumatic brain injury and suffered headaches, memory loss, vertigo, blurred vision and chronic pain.
The lawsuit alleged that Topgolf "failed to keep its property safe by placing seating areas near hitting bays without protective barriers," according to the Oregonlive.com story.
The same law firm secured a $16 million judgment against Topgolf when a federal jury in Portland in September of 2025 found the entertainment venue negligent after a 9-year-old boy was hurt after he got hit in the head by a golf club. The boy needed surgery and ended up with titanium plates in his head.
“These cases involve remarkably similar allegations,” said Sam Smith, a partner at Smith Foster King, told Oregonlive.com. “Our clients contend that the same hazard caused preventable injuries in each case. We hope the attention these cases have received leads to meaningful improvements in guest safety.”
