As was anticipated, Bayern Munich’s appeal of the red card suspension to Luis Díaz has been soundly rejected by the DFB — despite referee Christian Dingert admitting after the game that he made a mistake by issuing Díaz for diving.

The DFB’s sports court has rejected Bayern’s appeal. Luis Díaz’s ban against Union Berlin stands.
The DFB sports court’s explanation: “Referee Dingert stated that he observed player Díaz go down during a sprint
into the penalty area without any contact from the Leverkusen goalkeeper, which he considered an unsportsmanlike dive. While he only noticed the subsequent contact with the foot after reviewing the video footage following the match, even taking this into account, player Díaz had sought and made contact beforehand, so his decision was not entirely wrong. The fact that the referee’s decision would probably not have been made in the same way had the TV footage been taken into account is irrelevant for the sports court’s assessment. What is crucial is that the incident constitutes a factual decision, which can only be corrected if it is seriously, clearly, and beyond any doubt objectively incorrect. This is not the case here.”
As stated above, Díaz will be out against Union Berlin this weekend.
