The First Step: The Local Canvass
The official counting process begins at the local level in each of Texas’s 254 counties. This crucial first phase is called the local canvass. Contrary to the name, a 'canvass' isn't about recounting ballots one-by-one; it's the official process of compiling and verifying the vote totals from every precinct within the county. This responsibility falls to the county's commissioners court, which is the main governing body of the county, comprised of a county judge and four commissioners. The court must convene for the canvass to officially tabulate the results, including early votes, mail-in ballots, and Election Day totals. This meeting ensures that the precinct returns are accurately recorded and aggregated. It is at this stage that any late-arriving
mail ballots from overseas or military voters are processed and provisional ballots are reviewed and counted.
When the Local Canvass Happens
The timing for the local canvass is set by Texas election law to allow enough time to account for all validly cast ballots. For a general election, the commissioners court must conduct its canvass no earlier than the third day after the election and no later than the 14th day after the election. This window provides the necessary time for county election officials to handle provisional ballots and ensure all eligible mail-in ballots, particularly from military and overseas voters who have later deadlines, are included in the final count. Once the local canvass is complete, the results are no longer considered unofficial precinct returns but become the official results for that county. The presiding officer of the commissioners court, typically the county judge, then prepares the official report for submission to the state.
From County to State: The Secretary of State's Role
After each of the 254 counties certifies its local results, the county clerk prepares and forwards an official report to the Texas Secretary of State. The Secretary of State is Texas's chief election officer, and their office is the central hub for collecting the results from across the state. Their role is not to change or challenge the vote counts, but to receive, compile, and prepare the official county returns for the final step in the process: the state canvass. This administrative step ensures that all counties have reported their results in a uniform manner, creating a single, comprehensive statewide tally from the individual county-level certifications.
The Final Word: The Governor's Canvass and Proclamation
The final, authoritative certification for statewide and federal offices happens at the state level and is conducted by the Governor. The Texas Election Code specifies that the governor must conduct the state canvass not earlier than the 18th day or later than the 33rd day after the election. At the appointed time, the Secretary of State delivers the compiled county returns to the governor. The governor then reviews and certifies the official tabulations. This act makes the results official across the entire state. Following this state canvass, the governor issues a certificate of election to each winning candidate for statewide and federal offices, formally declaring them the victor. It is this final proclamation by the governor that officially concludes the election certification process in Texas.
