The Automatic Recount Trigger
An automatic recount isn't a matter of choice; it's mandated by law when an election is exceptionally close. The Oregon Secretary of State orders a full recount if the final vote tally shows a razor-thin margin between candidates or on a ballot measure. Specifically, a recount is required if there is a tie, or if the difference between the winning candidate and the runner-up is one-fifth of one percent (0.2%) or less of the total votes cast for both candidates. The same 0.2% margin applies to ballot measures. This process is a built-in feature of the state’s election system, designed to verify results in races where the outcome could plausibly be in doubt due to the small margin. These automatic recounts demonstrate the state's commitment to accuracy,
proving that even a handful of votes can make a significant difference.
When a Recount Is Requested
What if the margin is close, but not quite close enough to trigger an automatic recount? Oregon law allows for requested recounts. A candidate, or a political party on behalf of a candidate, can file a demand for a recount in specific precincts or for the entire election. Voters can also request a recount for any ballot measure. Unlike automatic recounts, these aren't triggered by a specific margin. The deadline to file such a request is typically no later than 42 days after the election. It's important to note that for a requested recount to officially change an election's outcome, it generally must be a 'full recount' of all votes cast in that race, not just a partial one covering select precincts.
The All-Important Question: Who Pays?
The funding for a recount depends entirely on how it was initiated. For automatic recounts triggered by a close margin, the government foots the bill. The cost is covered by the state for state-level offices, or by the relevant county, city, or special district for local races. However, for a requested recount, the person or party filing the demand is responsible for the cost. They must submit a deposit to the Secretary of State to cover the anticipated expenses. There is a significant exception: if a requested full recount changes the outcome of the election in favor of the candidate who requested it, their deposit is refunded. In rare cases, if it appears a material error by an election official may have altered the outcome, the Secretary of State can waive the deposit requirement.
How the Votes Are Actually Recounted
In Oregon, initial election results are tabulated by machines. Recounts, however, are a more hands-on affair. State law mandates that recounts are conducted by hand by a counting board. These boards consist of at least two election workers who must be registered with different political parties, ensuring bipartisan oversight. The process is methodical: ballot boxes are opened in the presence of the board, who then manually sorts the ballots into stacks based on the votes cast. The members of the counting board must independently count each stack and agree on the final number. This manual process is designed to catch any potential errors made by vote-tallying machines and to carefully interpret voter intent on each individual ballot.
From Recount to Final Result
Once a full recount is complete, the new abstract of votes becomes the official return of the election. The Secretary of State, who is responsible for ensuring all recounts are accurate and efficient, certifies the new results. While it's common for vote totals to shift slightly during a recount—often by just one or two votes—it is very rare for the overall outcome of an election to change. The process serves less as a mechanism for overturning results and more as a powerful tool for verification and building public trust. By providing a clear, legally defined, and transparent procedure for re-examining close results, Oregon’s recount system reinforces the integrity of the final vote count.
