It Starts at the Local Level
The first official step after Election Day happens in each of Kansas’s 105 counties. This process is called the canvass. It is conducted by the County Board of Canvassers, which in most Kansas counties consists of the county commissioners. Their job is to review the preliminary results compiled by the county election officer, ensuring every valid vote is counted accurately. This isn't just a simple recount; the board examines poll books, reconciles the number of ballots cast with the number of voters who signed in, and makes crucial decisions on the validity of provisional ballots. For example, a voter who cast a provisional ballot because they didn't have a photo ID has until this meeting to provide one to their county election office.
The County Canvass and Audit
Before
the county board can finalize its work, Kansas law requires a post-election audit. In each county, officials must manually audit the votes from at least one percent of the precincts, which are selected at random. This hand count is then compared to the machine totals from election night. If there are any discrepancies that can't be resolved, the Secretary of State or the local election officer can order a wider audit. This audit system provides a vital check on the accuracy of the vote-counting equipment. The results of the audit are presented to the County Board of Canvassers before they meet to certify the county's final results. This meeting must happen by the second Monday following the election.
Deadlines for the County Certification
Once the canvass and audit are complete, the county board officially certifies the results for all local races and prepares a formal report, known as an abstract, for statewide and federal races. This certified abstract is then sent to the Kansas Secretary of State. While the county canvass must begin by a specific date, counties are expected to transmit their final, certified results to the state as quickly as possible. If the Secretary of State doesn't receive a county's results within 14 days of the election, they are authorized to dispatch a messenger to retrieve them in person.
The Final Step: The State Board of Canvassers
The ultimate authority for certifying federal and state election results in Kansas is the State Board of Canvassers. This board is composed of the Governor, the Secretary of State, and the Attorney General. The Secretary of State's office first tabulates all the certified results received from the 105 counties into a single, statewide report. The State Board of Canvassers then meets publicly to review and formally approve this statewide compilation. Their job is to make the final canvass and certify that the totals are correct, officially determining who has won statewide offices, congressional seats, and state legislative races, as well as the outcomes of statewide ballot questions.
The Final Certification Date
The State Board of Canvassers must meet to certify the general election results no later than December 1 following the election. In practice, the meeting is often called by the Secretary of State as soon as all the county data is compiled and ready for review, which is typically in late November or early December. For the 2026 general election, state certification dates are scheduled across the country throughout November and early December. Once the Kansas state board votes to certify the statement of votes, the election results are final and official. The Secretary of State then issues certificates of election to the winners, formalizing their victory.
