What is the story about?

When the polls close, the process of finalizing an election is just beginning. In New Mexico, a multi-layered system of checks and balances ensures every vote is counted accurately before the results become official. Here’s how it works.

It Starts at the County Level

The first step in making election results official happens locally. After polls close on Election Day, each of New Mexico’s 33 counties begins its own canvass. This is essentially a detailed review to ensure the number of ballots cast matches the number of voters who signed in. This process is managed by the County Clerk's office. It's a meticulous, procedural step designed to catch and correct any discrepancies right at the source. This initial phase involves reconciling all the votes, whether they were cast on Election Day, during early voting, or by absentee ballot, and preparing a comprehensive report.

The County Canvassing Board Convenes

Once the county clerk's office prepares its report, the County Canvassing Board steps in. In most New Mexico counties, this board is composed

of the seated county commissioners. Their job is not to change results or conduct a recount, but to review the work of the clerk’s office and formally approve, or certify, the county's election results. Their duty is to ensure the process was followed correctly. By law, county boards must meet to approve their canvass report no sooner than six days and no later than ten days after the election. For larger counties with more than 150,000 voters, that window is extended to thirteen days. Once they certify the county's totals, the results are sent to the New Mexico Secretary of State.

The Secretary of State's Review

After all 33 counties have submitted their certified results, the process moves to the state level. The Secretary of State's office examines the election returns and certificates from every county. An independent auditor also conducts a review of the results before they are presented for final certification. This statewide compilation is another critical layer of verification, ensuring that the data from across New Mexico is consistent and accurately reported. This step aggregates the individual county results into a single, statewide picture, preparing the ground for the final certification.

The State Canvassing Board Gives Final Approval

The final authority for certifying statewide election results in New Mexico is the State Canvassing Board. This board is made up of three key officials: the Governor, the Secretary of State, and the Chief Justice of the New Mexico Supreme Court. This bipartisan or nonpartisan composition is a deliberate check on the process. This board has a specific deadline: it meets on the third Tuesday after each statewide election to review and approve the final canvass report. By signing the certificate of canvass, the board makes the results of the election official. This is the definitive date when the winners are formally declared. Certificates of election, however, cannot be issued to candidates until at least the 31st day after the election.
