It All Starts at the County Level
Contrary to what many believe, the certification process doesn't begin with the state's top election official. Instead, it is a decentralized effort that starts in each of California's 58 counties. Immediately following an election, local elections officials in each county begin what is known as the official canvass. This isn't just a simple recount of the votes tallied on election night. It is a meticulous period of verification and processing that ensures every valid ballot is counted accurately. This includes processing vote-by-mail ballots that were postmarked on or before Election Day and arrived within seven days, as well as provisional ballots cast on Election Day. It also involves verifying voter signatures and, if a signature is missing
or doesn't match, contacting the voter to give them a chance to fix it.
The Official Canvass: A 30-Day Marathon
California law provides county elections offices a 30-day period, known as the canvass, to complete their work. This month-long window is crucial for handling the sheer volume of ballots and the detailed work required. During this time, officials process late-arriving mail ballots, resolve provisional ballots, and handle any ballots that may have been damaged and require duplication. They also conduct a public 1% manual tally of ballots to audit and verify the accuracy of the machine count, a key check and balance in the system. This period is why the results you see on election night are always considered semi-official. The final, certified count takes time because democracy, when done carefully, is not instantaneous. Counties must work diligently, often for at least six hours a day, to meet their deadline.
County Certification: The First Major Deadline
By law, each of the 58 county elections officials must certify their final results and submit them to the Secretary of State within 30 days of the election. For a general election held on November 3, 2026, for example, this deadline would fall around December 3, 2026. This county-level certification is a major milestone. It represents the final, official vote count for all local contests within that county. Once certified, the county sends its 'statement of the vote' in an electronic format to the Secretary of State's office. This transmission officially passes the baton from the local authorities to the state, setting the stage for the final step in the process.
The Secretary of State Makes It Official
The final authority for certifying statewide election results in California is the Secretary of State. After receiving the certified results from all 58 counties, the Secretary of State's office compiles them into a single, comprehensive statewide report. This final compilation and certification must be completed on or before the 38th day after the election. For a November 3 election, this would place the final certification around December 11. On this date, the Secretary of State signs the official 'Statement of Vote,' which becomes the definitive record of the election. It is only at this point that the election results for statewide offices, federal offices like President and Congress, and statewide ballot measures are officially declared final for the entire state of California.
