Step 1: The Local Canvass
The certification process begins at the most local level, right after the polls close on Election Day. In each of Wisconsin's 1,850 municipalities, poll workers convene as the 'board of local canvassers'. Their job is to publicly reconcile the number of votes cast with the number of voters who checked in, ensuring everything matches. They don't declare winners; they simply verify the initial count. Municipal clerks are required to report these unofficial returns to their county clerk within two hours of tabulation. Following the election, they have until the next day to deliver all physical materials, like tally sheets and ballots, to the county.
Step 2: The County Board of Canvassers
Once municipalities report their numbers, the focus shifts to Wisconsin's 72 counties. Each county
has a board of canvassers, which typically consists of the county clerk and two other residents. By law, these boards must convene by 9 a.m. on the Tuesday following the election to begin their work. Their duty is to examine the returns from every municipality within their county, aggregate the totals, and resolve any clerical errors. This is a public process. The board’s role is administrative—to compile and confirm the numbers they received—not investigatory. They don't rule on fraud claims but ensure the arithmetic is sound across the county.
Step 3: The State-Level Review
After the county-level canvass is complete, each of the 72 county clerks must send a certified statement of their results to the Wisconsin Elections Commission (WEC). The WEC is the bipartisan state agency responsible for overseeing elections. For a general election, the deadline for counties to deliver these statements to the WEC is 14 days after the election. WEC staff then meticulously review and re-check the statements from all 72 counties, compiling them into a statewide summary of the vote. This centralized review ensures that all county reports are accounted for and properly tabulated before the final certification.
Step 4: The Final Certification and Key Deadline
The final, official act of certification rests with the chairperson of the Wisconsin Elections Commission. Following the statewide canvass, the chairperson is legally required to publicly certify the results. For a November general election, this must happen on or before December 1. It is at this moment that the results become official. The chairperson's duty to certify based on the verified totals is considered ministerial, meaning it is a mandatory act dictated by state law rather than a discretionary one. After this certification, the WEC prepares certificates for the winners. In a presidential election, the governor then has the duty to sign the certificate that names the state's electors.
What About Recounts?
Wisconsin law allows for recounts, but they happen within the certification timeline, not after. A candidate can petition for a recount if the margin is 1% or less. The petition must be filed shortly after the county canvass is completed. If a recount is ordered, it is conducted at the county level. The results of the recount are then transmitted to the WEC, and the final state certification deadline can be adjusted to accommodate the new timeline. This ensures that any recount is completed and its results are included before the final, official winner is declared.
