It All Starts at the County Level
The first official step after Election Day isn't a single certification, but a 'canvass'. This is the formal process where every vote is counted and verified. It happens at the local level, managed by each county's Board of Elections. These boards are responsible for tallying all the votes cast during early voting and on Election Day, as well as processing and counting all valid absentee, military, and affidavit ballots. This initial phase is methodical, designed to ensure every legitimate vote is included in the final count. It’s a far cry from the instant results often projected on election night; this is the detailed, official accounting that underpins the entire democratic process.
The Key Players: Bipartisan County Boards
So, who are these people doing the counting? In New York,
every county (and the City of New York) has a Board of Elections. Crucially, these boards are structured to be bipartisan. By law, they are led by an equal number of commissioners from the two major political parties. This structure is a foundational element of the state's approach to election integrity. The idea is that having both parties oversee the process ensures fairness and prevents any single political interest from controlling the outcome. These bipartisan teams work together to review ballots, rule on their validity when necessary, and oversee the entire canvass. This local, bipartisan verification is the bedrock of the state’s certification process.
The Local Deadline: A 25-Day Window
New York election law provides a specific timeline for this local work to be completed. Following a general election, county boards have up to 25 days to finish their canvass, finalize their vote counts, and officially certify their local results. This period allows them the necessary time to meticulously recanvass machine votes and review every paper ballot, including absentee and affidavit ballots which often require extra verification steps. Once the county board is satisfied with the accuracy of its count, it produces a certified statement of results. That certified document is then transmitted to the final authority in the state.
The Final Stop: New York State Board of Elections
After all 62 counties in New York have certified their individual results, the process moves to the state level. The New York State Board of Elections, based in Albany, is responsible for collecting the certified statements from every county. Their job is to aggregate these results to create a complete, official tally for all statewide and multi-county district races, such as those for governor, attorney general, and members of Congress. This is the final checkpoint. The state board's role is largely ministerial, meaning they compile the official counts sent by the counties rather than recounting votes themselves. They are the authority that produces the final, legally recognized outcome of the election for state and federal offices.
The Final Date: When It All Becomes Official
The last piece of the puzzle is the meeting of the State Board of Canvassers, which is a function of the State Board of Elections. For a general election without a presidential race, like the one in 2026, the board is required by law to meet on or before the 15th day after the election. However, various timelines exist for the full process. While counties have 25 days to send their results, the State Board of Canvassers has its own deadline to meet and certify the complete, statewide election results. According to the state's 2026 political calendar, the last day for the State Board of Canvassers to meet and certify the general election is projected for early December. It's on this date that the results of state and federal elections in New York become truly final and official.
