New allegations have emerged against Kroy "KJ" Biermann Jr. involving an underage relative.
The 15-year-old son of former "Real Housewives" star Kim Zolciak and ex-NFL player Kroy Biermann appeared in a Georgia court Friday, Sept. 11, for his ongoing felony sex-crimes case. During the proceedings, Deputy District Attorney Caitlin McGillicuddy alleged KJ Biermann had been under court supervision since October 2025 for a separate sexual battery charge, according to Page Six.
McGillicuddy said investigators discovered videos on KJ Biermann's phone that allegedly showed him having penetrative sex with a family member under the age of 12, the outlet reported,
adding that in the "multiple encounters" recorded, McGillicuddy alleged Biermann used "predatory, derogatory" language toward the victim.
He was later charged with sexual battery of a victim under the age of 16, per the outlet.
"This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims," McGillicuddy reportedly told the judge.
Biermann's lawyer Jason Sheffield responded to the allegations in court, stating he has not seen "that evidence" from the juvenile case but he has "asked to view" it.
"I understand the state's representation is meant honestly, but I haven't seen it, and what I have been told by other people who have seen it and turned it over, [is] that's not the case – that it is more feigning and more ridiculous, raunchy behavior," Sheffield said. "It's certainly boundary-crossing, inappropriate, but it has resulted in group counseling and reunification and acceptance by the juvenile court of the steps taken by all parties in law."
Sheffield further addressed the allegations in a statement to Page Six and TMZ: "The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case."
"The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense," Sheffield added. "Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved."
KJ Biermann faces 7 felonies, charged as an adult
Biermann is the eldest son of the "Real Housewives of Atlanta" alum and her ex-husband, who share six kids in total: KJ, 15, Kash, 14, twins Kaia and Kane, 12, along with Zolciak's daughters from a previous relationship Brielle, 29, and Ariana, 24, whom the former NFL player legally adopted in 2013.
Biermann was arrested and held without bond on Aug. 17 before being formally indicted Sept. 3 on one count of aggravated child molestation, aggravated sexual battery, aggravated sodomy and false imprisonment, as well as three counts of aggravated sexual battery against a child under 16.
He was granted bond following his Friday hearing, according to court records viewed by USA TODAY. Page Six reported Biermann's bond was set at $200,000 under the conditions that he must stay at Zolciak’s home, attend school virtually, no social media of any kind or cellphone use, no direct or indirect contact with victim or her family or associates, no contact with anyone aged 16 or under and he will be required to wear an ankle monitor.
The seven felony charges stem from an alleged incident that occurred in April, during which Biermann is accused of "intentionally" and "unlawfully" engaging in sexual acts with a teen girl without her consent, per the indictment obtained by USA TODAY. Biermann knew the girl through school.
In an Aug. 21 statement to USA TODAY, Sheffield said his client "is 100% innocent and tried to present evidence to the arresting officer," such as a voluntary polygraph test and evidence of "prior false allegations by the alleged victim."
"Sadly, these false allegations are a desperate cry for attention and are motivated by my client's past rejection of the alleged victim's unwanted advances," Sheffield continued, calling Biermann's arrest a "tragedy" and reiterating that he "is not only presumed innocent, but is in fact, innocent."
Sheffield later filed a "motion for transfer to juvenile court and for confidentiality proceedings" in an effort to avoid Biermann being tried as an adult. Sheffield told Page Six on Sept. 8 they also intend to enter a not guilty plea to all charges at an upcoming Oct. 14 arraignment hearing.
KJ Biermann allegations explained
According to the official complaint, Biermann ran into a girl who was best friends with his then-girlfriend at a local gym on April 23 and suggested they go to the co-ed sauna together, which is accessible through the family locker room.
Once in the locker room, according to the complaint, Biermann physically restricted the girl from leaving, leading to his false imprisonment charge, and "tried multiple times to have sexual intercourse" despite her saying no. She also alleged he forced his genitals into her mouth against her will, for which he was charged with aggravated sodomy, and committed other sexual offenses including digital penetration before she was able to escape.
Sheffield spoke out again in a Sept. 3 statement to USA TODAY, saying while there are "extraordinary consequences" of Biermann's indictment, "adult consequences do not transform a child into an adult."
She went to the hospital the next day, where she had a sexual assault examination done and spoke with officers, who were able to corroborate the timeline of events through security footage at the gym. The sexual assault kit returned no evidence of male DNA in the victim's mouth or genitals, the report said.
"The choices and conduct of children should not suddenly be viewed through an adult lens simply because the consequences are severe," Sheffield said, warning that "an arrest and an indictment cannot tell us the whole truth of a case because, at those stages, the magistrate judge and the grand jury have heard only one side."
"Without DNA evidence, the case remains one of 'she said, he said' and the credibility of the accuser," he continued. "The evidence that I have gathered will prove, at the appropriate time and place, that KJ Biermann is not guilty of these horrific allegations. God willing, that place will be juvenile court, where the lives of these young people can be respected and honored."
Sheffield concluded, "Until then, these are children whose lives should not become something for adults to 'thumbs up' or 'heart' on social media. We should not cheer against children."
