What a summer of bad optics for the leadership of the San Francisco 49ers.
The revelation on Monday that 49ers owner Jed York spent a day locked up in Ohio after pleading no contest on two misdemeanor charges – plea-bargained down from an initial charge of “engaging in prostitution” – comes on the heels of coach Kyle Shanahan’s SUV crash
in July, which was followed by a saga of an incorrect accident report the coach later corrected in admitting the accident was his fault.Sure, these are two completely unrelated episodes with vastly different types of activity.
Yet one thing is certain: The 49ers can only wish they were able to hide York’s indiscretions.
News can travel fast in cases like these – an arrest, a mugshot and jail time. All confirmed
by authorities in East Palestine, a tiny village in Columbiana County near the Ohio-Pennsylvania border, now unexpectedly pinned on the NFL map.
York, 46, was arrested at an address in a trailer park after he responded to an online ad and sought to arrange sexual activity for $140, according to court documents obtained by USA TODAY Sports.
York, one of the NFL’s youngest and most progressive owners, the nephew of Hall of Famer Eddie DeBartolo Jr., just lost a ton of cool points – and not because of the apparent location of his arrest, which is about 30 miles from where he grew up in Youngstown – for getting caught up in the mess.
The best effort from the 49ers to publicly address the matter came in the form of a statement from the team that declared: “As this is a legal matter, which has been resolved, we will not be providing any further comment at this time.”
The legal matter may be resolved but the fallout is only beginning.
Suddenly, there’s another item on the agenda – officially or not – for NFL owners to ponder as they gather in Atlanta for league meetings on Wednesday. The NFL is reviewing York under terms of its personal conduct policy, which touts the debatable “higher standard” for owners, and nonetheless suggests that some form of discipline could be just around the corner for York.
NFL punishment could come quickly for Jed York
It’s worth noting that when the late Indianapolis Colts owner Jim Irsay was suspended for six games and fined $500,000 in 2014, NFL Commissioner Roger Goodell issued the discipline on the very September day that Irsay pleaded guilty to a misdemeanor charge on driving while intoxicated that stemmed from a March arrest.
So, there’s some precedent for quick action after the legal issue was resolved – although in Irsay’s case it was a matter of waiting months with much buzz, shame and anticipation before the case was settled.
Of course, two former owners – Dan Snyder and the late Jerry Richardson – were forced, if not formally, to sell their franchises, the Commanders and Panthers, respectively, amid workplace misconduct allegations. An independent investigation initiated by the league concluded that Snyder sexually harassed a female employee in addition to financial improprieties, resulting in a record $60 million fine on the way out. Even so, considering the enormous profits generated with their sales – Snyder reportedly made a $5.25 billion profit after the team sold for a then-record $6.05 billion in 2023, according to USA TODAY Sports reporting, while Richardson reportedly made $1.2 billion from a then-record $2.275 billion sale in 2018 – their “punishment” came with profit.
Then again, it’s also worth noting that there was no type of discipline in two cases in recent years when NFL owners were at least associated with sketchy behavior. Former Giants co-owner Steve Tisch’s name surfaced in the Epstein files in January, in multiple email exchanges with convicted sex offender Jeffrey Epstein that involved arrangements to connect with various women. Tisch was not disciplined by the NFL but instead this year transferred his stake in the franchise to a trust that allows it to be passed along to his children.
New England Patriots owner Robert Kraft wasn’t disciplined after his arrest in 2019 during a sting operation in South Florida. Solicitation charges against Kraft were ultimately dropped, although it’s fair to wonder whether the Patriots architect – with six Super Bowl rings – has paid a price with his omission from the Pro Football Hall of Fame.
Humiliation serves as instant punishment
Back to York, now setting foot in the NFL Owners Hall of Shame. Whatever discipline comes from this could pale to the hit on his reputation.
In other words, York is already blasted by the instant punishment of humiliation that may seem heavier than a fine, suspension or the day spent in lock-up.
He’s drawn negative attention to himself – and by extension the franchise that as a younger man he seemed destined to run long before inheriting controlling interest in 2024 – for what would have been a really cheap thrill.
What a bad look. Was it worth it? Of course not.
And now, away from the public eye, comes the soul-searching and other challenges a high-profile human being is suddenly forced to confront in his personal life.
