Timothy Busfield's child sex-abuse case has been thrown out.
A New Mexico judge granted the 69-year-old producer's motion to dismiss his grand jury indictment on Friday, Oct. 16, according to documents obtained by USA TODAY.
In his ruling, the judge said: "The prosecuting attorney failed to act in a fair and impartial manner, including the failure to properly instruct the grand jury on the law for calling witnesses and in instructing the grand jurors on a procedure that effectively withheld requested witnesses."
As a result, the jury was unable to make an informed decision.
"The State, however, remains free to institute new criminal proceedings against" Busfield, per the ruling.
Busfield was indicted in February on four counts of criminal sexual
contact of a child stemming from alleged incidents with two minor twin boys between late 2022 and early 2024 when he was working as a director and producer on Fox's "The Cleaning Lady." He denies all allegations.
