An Election Night Cliffhanger
On November 5, 1974, voters in New Hampshire went to the polls to pick a successor for retiring Republican Senator Norris Cotton. The race pitted Republican Congressman Louis Wyman against Democratic Insurance Commissioner John Durkin. In a year soured for Republicans by the Watergate scandal and President Nixon's resignation just months earlier, the race was expected to be competitive, but no one predicted just how much. As the initial votes were tallied, Wyman emerged with a slim lead of just 355 votes out of more than 220,000 cast. In any other election, that might have been the end of it. But Durkin, citing potential irregularities, immediately demanded a recount, plunging the state into an unprecedented political drama.
The Recount Rollercoaster
The first recount,
completed in late November, didn't just tighten the race—it flipped it entirely. Suddenly, Democrat John Durkin was the winner by a razor-thin margin of 10 votes. New Hampshire's Republican Governor, Meldrim Thomson Jr., reluctantly issued Durkin a provisional certificate of election. Unwilling to accept defeat, Wyman's campaign appealed to the state's Ballot Law Commission. This Republican-controlled board conducted its own review of disputed ballots. On Christmas Eve, they delivered their decision: Wyman had won by a microscopic margin of just two votes. The governor rescinded Durkin’s certificate and awarded one to Wyman, leaving New Hampshire with two different winners declared in the span of a month.
A Crisis in the U.S. Senate
With the state unable to declare a definitive winner, the battle moved to Washington, D.C. The U.S. Constitution makes the Senate the final judge of its members' elections, so Durkin petitioned the Democrat-controlled body to intervene. What followed was seven months of partisan gridlock. The Senate Rules Committee took possession of 3,500 disputed ballots from New Hampshire, but couldn't reach a consensus. On the Senate floor, Republicans launched a successful filibuster to prevent Democrats from seating Durkin. Six separate votes to end the debate failed, and the business of the Senate ground to a halt over one vacant seat. New Hampshire had no junior senator, and the chamber was deadlocked.
The Unprecedented Do-Over
By the summer of 1975, both sides were exhausted. Seeing no end to the stalemate, Wyman made a surprising proposal: forget the whole thing and hold a brand-new election. After initially refusing, Durkin agreed. On July 30, the Senate voted to officially declare the seat vacant. A special election was scheduled for September 16, 1975. After nearly a year of intense media attention and political wrangling, Granite State voters were more engaged than ever, turning out in record numbers. This time, there was no ambiguity. John Durkin won the special election by a decisive margin of more than 27,000 votes, finally ending the longest and closest contested Senate election in American history.
