An Election Night Cliffhanger
On November 4, 2008, nearly 2.9 million Minnesotans cast their ballots in a hard-fought battle between incumbent Republican Senator Norm Coleman and his Democratic-Farmer-Labor challenger, the comedian and author Al Franken. As the initial results rolled in, it became clear the race was extraordinarily tight. By the time the dust settled, Coleman held a lead of just 215 votes. In an election with millions of participants, the margin was a statistical whisper, well within the 0.5% threshold that, under state law, triggers an automatic, taxpayer-funded recount. Coleman declared victory, but Franken refused to concede, setting the stage for one of the most intense and prolonged electoral disputes in modern American history.
The Grueling Recount Begins
What followed was not
just a simple retallying but an exhaustive, statewide hand recount of every single ballot. For weeks, representatives from both campaigns, alongside election officials, hovered over tables in 120 locations, scrutinizing each vote. The process was a study in electoral minutiae, as lawyers for both sides challenged thousands of ballots over voter intent—was a stray mark an error, a doodle, or a valid vote? Famously, one ballot was challenged because the voter had written in 'Lizard People'. As the painstaking process unfolded through November and into December, the lead swung back and forth. Coleman's initial 215-vote advantage dwindled, and at times, Franken pulled ahead by a handful of votes, only to see the lead evaporate again.
From Recount to Courtroom Battle
After the initial hand recount and the review of challenged ballots, the focus shifted to the courts. The primary new battleground became improperly rejected absentee ballots. The Franken campaign argued that thousands of these ballots had been wrongly disqualified and should be opened and counted. The Coleman campaign fought this, and the issue escalated to the Minnesota Supreme Court, which established a process for reviewing these ballots. On January 5, 2009, after counting a batch of these absentee ballots, the State Canvassing Board certified Al Franken as the winner by 225 votes. But it was far from over. Coleman immediately filed an election contest, a lawsuit challenging the result, and Minnesota's Senate seat remained vacant as the new Congress was sworn in.
A Winner After Eight Months
The election contest unfolded in a seven-week trial before a three-judge panel. The proceedings were a deep dive into election law, examining claims of double-counting and unequal standards for accepting absentee ballots across different counties. On April 13, the panel unanimously ruled in Franken's favor, increasing his lead to 312 votes. Coleman appealed this decision to the Minnesota Supreme Court. Finally, on June 30, 2009, nearly eight months after Election Day, the state's highest court unanimously upheld the lower court's decision, declaring Franken the winner. Coleman conceded that day, and Al Franken was sworn into the U.S. Senate on July 7.
