Congress's Internal Watchdogs
Both the House of Representatives and the Senate have their own ethics committees, which are unique because their membership is split evenly between Democrats and Republicans. The House Committee on Ethics and the Senate Select Committee on Ethics are tasked with enforcing the rules of conduct for their respective chambers. Their job is to investigate allegations of wrongdoing, provide guidance to members on how to follow the rules, and review things like financial disclosures. The core idea, established in the U.S. Constitution, is that each chamber of Congress has the power to police its own members. These committees serve as the primary mechanism for that self-regulation, handling everything from misuse of funds and conflicts of interest
to violations of campaign finance law.
How an Investigation Gets Started
An ethics investigation can be triggered in several ways. In the Senate, the committee can launch a probe based on a formal complaint or simply credible information it becomes aware of, often from media reports. In the House, the process is a bit more complex. Since 2008, an independent body called the Office of Congressional Conduct (OCC)—formerly the Office of Congressional Ethics (OCE)—can review allegations from the public. This non-partisan office, governed by private citizens, conducts a preliminary review. If the OCC board finds substantial reason to believe a violation occurred, it refers the matter to the House Ethics Committee for further review. The House committee can also launch its own investigations based on complaints from other members of Congress.
The Toolkit of Consequences
Once an investigation is complete and a violation is found, the committees have a range of disciplinary actions they can recommend. It's important to note that the committees themselves can typically only issue letters of reproval or admonishment. More severe punishments must be voted on by the full House or Senate. These can include: a 'reprimand', which is a formal statement of disapproval from the chamber; 'censure', a more severe public rebuke that requires the member to stand before their peers as the resolution is read; a fine; or loss of seniority or committee assignments. The most severe penalty is expulsion from Congress, which is extremely rare and requires a two-thirds vote of the member's chamber.
The Political Reality Check
While ethics committees have real powers on paper, their effectiveness is often constrained by political reality. Because punishments like censure and expulsion require a vote by the entire chamber, partisanship can play a huge role. It is incredibly difficult to get two-thirds of a chamber to agree to expel one of their own, which is why it has happened so infrequently in American history. Furthermore, investigations can be slow and opaque, with no set timeline for the committees to act. Often, members facing a serious ethics investigation will choose to resign rather than face a public sanction hearing or a vote for expulsion, effectively short-circuiting the process. As a result, while the committees are a crucial tool for accountability, their power is ultimately wielded not in a courtroom but in a highly political arena where party loyalty and self-preservation can often outweigh the formal rules.
