A Signature Instead of a Stamp
The franking privilege is the ability of members of Congress to send mail related to their official duties without postage. Instead of a stamp, the member's signature—or a printed version of it, known as the 'frank'—is placed on the envelope. This signals to the U.S. Postal Service that the mail is official and should be delivered. The practice dates back to the British Parliament in the 17th century and was adopted by the Continental Congress in 1775 to ensure lawmakers could keep their constituents informed. While it's 'free' for the sender, the costs are ultimately reimbursed to the postal service by Congress from taxpayer-funded budgets.
What's Covered as 'Official Business'?
The law states that franked mail must be for 'official business'. This generally includes communications
that are part of a representative's duties, such as responding to constituent inquiries, sending newsletters about legislative activity, announcing town hall meetings, and distributing government reports. It can also include things like questionnaires to solicit opinions on public issues or congratulatory notes for public distinctions like acceptance into a military academy. However, the privilege is not a blank check for any and all mail. The rules are specific about what is not allowed.
The Rules of the Game
To prevent abuse, Congress has established strict limits. Franking cannot be used for purely personal mail, like holiday cards, or for any campaign-related activities. This means no fundraising solicitations, no get-out-the-vote efforts, and no materials that are explicitly political. To enforce these rules, the House and Senate have oversight bodies, most notably the House Communications Standards Commission (formerly the Franking Commission). This bipartisan group reviews mass mailings to ensure they comply with regulations. Furthermore, there is a 'blackout' period before elections—90 days for the House and 60 days for the Senate—during which members who are candidates are prohibited from sending any unsolicited mass mailings.
Incumbency's Edge and Modern Controversies
Despite the rules, the franking privilege remains controversial. Critics argue it gives incumbent politicians an unfair taxpayer-funded advantage, allowing them to flood their districts with what often looks like campaign literature, even if it technically follows the rules. The volume of mail often spikes in election years, suggesting a political motivation. The rise of the internet has added another layer. The rules have been updated to cover digital communications like emails and social media ads, acknowledging that 'mail' is no longer just physical. These regulations attempt to balance a lawmaker's need to communicate with constituents against the potential for using public funds to boost their own profile, a debate that has been ongoing since the privilege began.
