The Two-Vote System: Why These Questions Are Back
Before diving into the specifics, it’s important to understand Nevada's unique process for citizen-led constitutional amendments. Unlike a simple majority vote in other states, Nevada requires these initiatives to be approved by voters in two consecutive general elections. The measures on the 2026 ballot, Questions 6 and 7, both passed in November 2024. Now, they're back for a final verdict. If they pass again, they become part of the Nevada Constitution. Several other initiatives were circulated, but none gathered enough signatures to qualify, leaving just these two statewide questions for voters to decide.
Question 6: The Right to Abortion Initiative
This measure proposes to amend the Nevada Constitution to create a fundamental, individual right to abortion. Specifically, it would protect
abortion access until fetal viability, which is determined by a qualified healthcare professional. An abortion would also be permitted after viability if it's necessary to protect the life or health of the pregnant individual. A 'yes' vote supports adding this right to the state constitution, creating a durable protection that can't be easily changed by future legislatures. A 'no' vote would reject the constitutional amendment, leaving abortion rights governed by existing state law, which already permits the procedure. Proponents, led by groups like Nevadans for Reproductive Freedom, argue that while Nevada law currently protects abortion, enshrining it in the constitution is a necessary safeguard against future political shifts or legal challenges. Opponents raise concerns about amending the constitution for a right already protected by statute and argue about the specific definitions and potential long-long term implications of the amendment's language.
Question 7: The Voter Identification Initiative
Question 7 seeks to amend the state constitution to require voter identification. If it passes, voters would need to present a form of photo ID when voting in person. For those voting by mail, the measure would require them to provide an identifying number, such as the last four digits of their driver's license or Social Security number, to verify their ballot. A 'yes' vote supports adding these voter ID requirements to the Nevada Constitution. A 'no' vote would reject the amendment and keep Nevada's current system, which primarily relies on signature verification to confirm a voter's identity. Supporters of the measure argue that requiring photo ID is a common-sense step to enhance election security and increase public confidence in the voting process. Opponents argue that it creates an unnecessary barrier to voting that could disproportionately affect senior citizens, low-income individuals, and rural voters who may not have easy access to a valid photo ID. They contend that the current signature verification system is secure and that there is no evidence of widespread voter impersonation to justify the change.
