First, How Does This Process Work?
Before a proposal to change the Pennsylvania Constitution can get to you, the voter, it must pass through a specific process. Unlike regular laws, constitutional amendments don't require the governor's signature. Instead, a proposed amendment must be passed by a simple majority in both the state House and Senate in two consecutive legislative sessions. Once it clears that high bar, it's placed on the ballot for all registered voters to approve or reject. This process has become a key tool for lawmakers, especially in a divided government, to enact policy changes that might otherwise be vetoed. Voters have historically approved the vast majority of amendments that reach them.
Preference for Local and Small Businesses
One of the key questions expected on the ballot would amend the Philadelphia
Home Rule Charter to give preference to small and local businesses when the city awards contracts. Currently, the city spends over a billion dollars a year on goods and services. Proponents, including the sponsoring councilmembers and local business groups, argue this change would boost the local economy, create jobs, and help lift residents out of poverty by keeping tax dollars circulating within the community. The measure is partly a response to legal challenges that previously targeted the city's contracting practices. A 'yes' vote would allow the city to formally implement policies that favor small and Philly-based companies. Opponents sometimes raise concerns that such measures could reduce competition, potentially increasing costs for taxpayers if non-local or larger firms that can offer lower bids are passed over.
Making the Office of Arts and Culture Permanent
Another proposal for Philadelphia voters seeks to formally establish 'Creative Philadelphia', the city's arts and culture office, within the City Charter. This office is responsible for promoting the city's creative economy and increasing public access to cultural events. Supporters say that making the office a permanent part of the city's foundational document would protect it from the shifting priorities of future administrations and ensure long-term stability for the arts sector. A 'yes' vote solidifies the office's place in government. Those who might argue against it often do so on fiscal grounds, suggesting that enshrining an office in the charter reduces flexibility in budgeting and government administration down the line, making it harder to reorganize or cut spending if needed.
The Broader Fight Over Constitutional Changes
Beyond the local level, several significant statewide constitutional amendments have been debated in the legislature and could appear before voters. These proposals highlight major political battles in Harrisburg. One significant package of amendments passed by the legislature in a previous session includes measures that would declare the state constitution does not grant a right to abortion, give the legislature power to reject regulations without a governor's veto, and add stricter voter ID requirements. These proposals are highly contentious. Supporters argue they restore power to the legislative branch and allow for greater oversight, while opponents, like the League of Women Voters, contend they would dramatically shift the balance of power, strip rights, and create barriers for voters. The journey of these amendments to the ballot is a key story to watch in Pennsylvania politics.
