Maryland's Eight-District Map
For decades, Maryland's representation in the U.S. House of Representatives has been set at eight districts. This number remained unchanged after the 2020 U.S. Census, reflecting steady population growth relative to the rest of the country. Politically, Maryland is a deep-blue state, and this is reflected in its congressional delegation, which currently consists of seven Democrats and just one Republican. That 7-1 split has been the focus of intense debate, particularly during the redistricting process that occurs every ten years. While the number of seats hasn't changed, the boundaries of the districts themselves became the subject of a major political and legal showdown following the most recent census count.
The Post-2020 Redistricting Fight
Following every census, states
redraw their congressional and legislative boundaries to ensure districts have roughly equal populations. In Maryland, this process is controlled by the state legislature. After the 2020 Census, the Democratic-controlled General Assembly undertook this task during a special session in late 2021. They passed a new congressional map that was immediately criticized by Republicans and good-governance advocates as an extreme partisan gerrymander. The map was designed to further solidify the Democratic majority by making the state's lone Republican-held seat, the 1st Congressional District, significantly more competitive for a Democrat. Then-Governor Larry Hogan, a Republican, vetoed the map, but the legislature quickly overrode his veto.
A Court Strikes Down the 'Extreme' Gerrymander
The fight then moved to the courts. Republican voters filed a lawsuit arguing the new map was an illegal partisan gerrymander under the Maryland Constitution. In a landmark decision in March 2022, a Senior Judge for the Anne Arundel County Circuit Court, Lynne Battaglia, agreed with the challengers. She struck down the legislature's map, calling it a "product of extreme partisan gerrymandering" that violated the state constitution's provisions requiring that districts be compact and respect political boundaries. It was a rare judicial rebuke of a congressional map on state-level partisan gerrymandering grounds, forcing lawmakers back to the drawing board under a tight deadline.
A New, Compromise Map Emerges
Faced with the court order, the General Assembly passed a new, revised map at the end of March 2022. This second version was seen as a compromise. While still favoring Democrats overall, it created a more compact and coherent 1st Congressional District, which covers the Eastern Shore. The new lines made the district less of a Democratic target and more securely Republican compared to the first draft, though it remained more competitive than it had been the previous decade. Governor Hogan signed this revised map into law in April 2022, ending the legal battle and setting the congressional boundaries for the state's elections through 2030.
The Lasting Impact on Maryland Politics
The new, court-ordered map is now the law of the land, used for the 2022, 2024, and upcoming 2026 elections. The political landscape, while still heavily tilted toward Democrats, saw a significant shift from what was initially proposed. The 1st District, held by Republican Andy Harris, became slightly less Republican but remains the only GOP-held seat in the state. The saga put a national spotlight on Maryland as an example of Democratic gerrymandering, just as states like Texas and North Carolina face criticism for Republican gerrymandering. The issue is far from settled, however. In 2026, Maryland voters will decide on a constitutional amendment, Question 3, which could remove the very standards for compactness and contiguity that Judge Battaglia used to strike down the 2021 map, potentially setting the stage for an even more intense redistricting battle after the 2030 census.
