How Many Congressional Districts Does New York Have in 2026?

The short answer is 26. But that simple number is the result of a years-long political saga involving the U.S. Census, bitter court battles, and a frantic redrawing of the state’s political map, with huge consequences for national politics.

The Magic Number: 26

For the 2026 midterm elections, New York will send 26 representatives to the U.S. House. This is one fewer than the 27 districts the state had for the previous decade. The map dictating these 26 districts was enacted on February 28, 2024, and will remain in place for the 2026 elections despite some later legal challenges that were ultimately blocked or dismissed. While elections are held every two years, the number of districts a state gets is only re-evaluated once a decade, making the story behind that number a compelling one.

Why New York Lost a Seat

The change from 27 to 26 seats was a direct result of the 2020 U.S. Census. The process, called apportionment, divides the 435 seats of the House of Representatives among the 50 states based on population. While New York’s

population did grow, it didn't grow as fast as other states, particularly in the South and West. The margin was painfully thin; census officials later noted that if New York had counted just 89 more people, it would have kept its 27th seat. This loss continued a long-term trend for the Empire State, which has seen its congressional delegation shrink from a peak of 45 seats in the 1950s.

The Great Redistricting Mess of 2022

Losing a seat is one thing; deciding how to draw the lines for the remaining seats is another. New York's redistricting process following the 2020 Census was a political and legal rollercoaster. A newly created Independent Redistricting Commission (IRC), designed to prevent partisan gerrymandering, deadlocked and failed to produce a consensus map. The Democratic-controlled state legislature then drew its own aggressive map, which was widely seen as an attempt to create a 22-4 Democratic advantage in the delegation. However, Republicans challenged the map in court, and in a stunning decision in April 2022, New York's highest court threw it out, ruling it was an unconstitutional partisan gerrymander. The court then appointed a neutral 'special master' to draw a new, more competitive map. This court-drawn map was used for the 2022 elections and was seen as a major factor in Republicans flipping several New York seats, helping them secure a narrow majority in the U.S. House.

A New Map for 2024 (and 2026)

The story wasn't over. Democrats, arguing the special master's map was only a temporary fix, launched new legal efforts to have the maps redrawn again. This led to another round of political maneuvering. In late 2023, a court ordered the Independent Redistricting Commission to reconvene and try again. The IRC produced a new map in early 2024. The legislature, however, made modest adjustments to that proposal before passing a final version that Governor Kathy Hochul signed into law on February 28, 2024. This is the map that was used for the 2024 elections and is the map that will govern the 2026 contests. While less aggressive than their first failed attempt, the final map was seen as slightly more favorable to Democrats than the court-drawn version from 2022, setting the stage for intense competition across several key districts in 2026.
