A Boca Raton police officer who fatally shot a 39-year old man during a 2024 encounter was justified in his actions, the Palm Beach County State Attorney's Office has determined.
The investigation determined officer Michael Super used reasonable force in the Dec. 18, 2024, shooting of Morey Clemmons. Super's use of deadly force was "objectively reasonable under the circumstances and his actions were legally justified,” the State Attorney's Office said in a stament.
Boca Raton police previously reported that Super encountered Clemmons shortly before 11:30 a.m. on Dec. 18, 2024 between Northwest Second Avenue and Palmetto Park Road, north of City Hall and near the Boca Raton Community Center.
Super, a city police officer since 2019, fired his weapon
at some point during the encounter, police said at the time. Investigators have not said why the officer fired shots or provided a detailed narrative of what happened in the confrontation.
The Florida Department of Law Enforcement investigated the shooting and provided its findings to the State Attorney’s Office. The State Attorney's Office has not revealed those findings.??
Boca Raton police will now conduct an administrative review of the shooting. The review is separate from the criminal investigation and will examine the circumstances and whether Super followed department policies and procedures.
"Officer-involved shootings have a profound impact not only on those directly involved, but also their families and the broader community,” said Boca Raton Police Chief Jarad Phelps in a prepared statement. “The Boca Raton Police Services Department remains committed to transparency and will continue to share information as the process moves forward.”
