A popular kosher grocery store will remain in a Boynton Beach-area shopping plaza after a Palm Beach County judge dismissed a recent eviction lawsuit against it.
The owner of the Village Square at Golf shopping plaza at Woolbright Road and Military Trail had alleged in a lawsuit filed June 4 that the KC Market chain owed $361,000 in unpaid rent.
KC Market claimed the landlord, New York-based real estate investment firm DRA Advisors, owed it more than $565,000.
DRA and KC Market settled their dispute amicably, said the grocer's owner, Joseph Gopin. "KC Market is here to stay," he said. He did not answer questions about the details of the deal his store and its landlord reached.
The case was dismissed Aug. 7, Palm Beach County Circuit Court records
show.
KC Market planned to open its long-planned bagel restaurant, Boss Bagels, this month, Gopin said.
An attorney representing DRA, Ricardo Reyes of Boca Raton-based Tobin & Reyes, did not respond to a request for comment.
KC Market signed the Village Square lease in 2022 in what it called its first "supersize" spot, the 40,000 square-foot former Publix at 3775 Woolbright Road.
But by mid-2025, financial disputes erupted between KC Market and DRA. Each company claimed one owed the other for repairs, upgrades and other items in accordance with the lease. The value alleged by both parties reached into the hundreds of thousands.
Along with its stores in the Village Square plaza, KC Market also runs shops in Hollywood and Hallandale Beach in Broward County.
