An El Paso man allegedly confessed to his sister that he fatally shot their brother after a night of drinking and arguing, court documents state.
"I (expletive) did it!" Jose Luis Garcia, 40, said to his sister as he was sobbing over the phone about killing his brother, Lorenzo Alba, 32, a criminal complaint affidavit states.
Garcia is facing one count of murder in connection with the Monday, Sept. 21, fatal shooting of his brother at a house in the 1700 block of Charlie Smith Drive in the Montwood area of El Paso. He is also facing an evading arrest or detention with a vehicle charge after leading law enforcement on a chase.
Attorney Max Daniel Munoz, who is representing Garcia, declined to comment on the case.
'I (expletive) did it'

responded to a report of a shooting about 6:20 a.m. when they found the sister talking to Garcia on the phone outside the far East El Paso home.
The sister told officers that Garcia said, "I (expletive) did it," as he cried. He told her, "don't go in the (expletive) house!" and that he was "sorry," the affidavit states.
The sister said she asked Garcia what he had done, but he would not answer. Garcia allegedly told her that he had "obtained a lot of drugs and that he was going to end it," the affidavit states.
Garcia kept calling the sister and stating the same things over and over, but he would hang up on her, the affidavit states. The sister kept trying to call Garcia, but he kept hanging up.
Officers found Alba dead inside the house with gunshot wounds. The officers found multiple guns inside the house and spent casings around Alba's body.
Drinking, arguing lead to fatal El Paso shooting
A witness told officers that he saw Garcia run out of the house and leave in a maroon Dodge Ram.
The witness told officers that Garcia and Alba were drinking and arguing the whole night, when they got into a fight, the affidavit states. The men stopped fighting, with Garcia going upstairs and Alba going to the kitchen.
Garcia allegedly came downstairs moments later with a rifle, the witness told officers, the affidavit states. The witness asked Garcia, "What the (expletive) are you doing?"
He allegedly replied, "Get the (expletive) out of the way!" The witness ran outside of the house and heard "multiple shots in quick succession," the affidavit states. The witness went back into the house and saw Alba on the floor, eyes open, not moving. Alba was lying on his back with a large pool of blood around his head.
I "(expletive) up," Garcia allegedly told the witness. Garcia ran out of the house and drove off in the Dodge truck, according to the affidavit.
El Paso murder suspect talks to sister, cops on phone
Officers took the men's sister to a police station to be questioned about the shooting. As officers were questioning her, she called Garcia and put the phone on speaker.
Garcia allegedly said that there was no other way out and that he was driving on a dirt road in Horizon City. He "repeatedly stated that he (expletive) up and that he was sorry," the affidavit states. Garcia then ended the call.
Officers saw the truck at the intersection of Mesa Street and Wyoming Avenue near Downtown El Paso. The truck was registered to Alba. A patrol officer attempted to pull over the truck, but Garcia fled from the officers, the affidavit states.
Police chase from Downtown El Paso to Horizon City
Texas Department of Public Safety state troopers joined the chase near Interstate 10 East and Lee Trevino Drive in East El Paso.
A trooper conducted a "PIT maneuver" to stop Garcia in the area of Desierto Lindo Avenue and Maravillas Street in Horizon City, an El Paso police news release states. A PIT maneuver (Precision Immobilization Technique) is when law enforcement uses their patrol vehicle to strike the side of another vehicle, forcing it to go sideways in an attempt to stop it.
Garcia was arrested on suspicion of murder and evading arrest or detention with a vehicle. He was booked into the El Paso County jail. He is being held without bond on the murder charge, while his bond on the evading arrest charge was set at $50,000.
