A man charged in connection with a two-vehicle crash that killed an elderly woman in early August has been returned to Marion County to face his charges.
Here's what we know about that and another case addressed at the Marion County Judicial Center the week of Sept. 7:
State v. Masaiah Mike Enriquez
Judge: County Judge Robert Landt.
Lawyers: Assistant State Attorney William Hodges and defense attorney John P. Senkarik.
Charges: Vehicular homicide, reckless driving and fleeing and eluding a law enforcement official at high speed.
Reason for court? First appearance on Sept. 11. Enriquez was picked up by U.S. Marshals in Miami in mid-August on a Marion County warrant issued after the deadly Aug. 8 crash. Records show Enriquez was booked into the Marion County jail on Sept. 10.
What
happened during the hearing? Defense attorney Senkarik told the judge that Enriquez's vehicle was not the one that caused the fatal crash. Prosecutor Hodges disagreed.
The judge ruled that on the vehicular homicide charge, the defendant could be released on his own recognizance, known as ROR. For the remaining two charges, Enriquez's bail was set at $10,000 total. He also has a warrant from Citrus County for a fleeing and eluding charge; in that case, he's being held without bail.
What's next? Enriquez has an Oct. 13 arraignment date.
About the case: Florida Highway Patrol troopers said Enriquez, 21, and Cesar Ramon Estrada Garcia, 28, were racing along Southwest 49th Avenue Road when a Toyota RAV4 SUV pulled out from Southwest 82nd Place Road and was turning left.
The SUV was struck by Garcia's BMW. Enriquez was also driving a BMW. Enriquez fled.
Troopers said Myrna Gonzalez, 77; her 78-year-old husband, Loy Gonzalez; and their son, Christopher Gonzalez, 48, who was driving, were in the SUV.
Myrna Gonzalez died at HCA Florida Ocala Hospital, FHP said. The woman's husband was seriously injured and their son had minor injuries. Both have since been released from the hospital.
Troopers received information that Enriquez was the other driver and recovered his vehicle at a Marion Oaks residence. FHP officials interviewed a man who said Enriquez told him about the wreck. The man said he told Enriquez to report the crash, but Enriquez told him no.
Records show prosecutors have filed vehicular homicide and racing on highway charges against Garcia, who has been released from jail on bond.
State v. William Grady Ary
Judge: Circuit Judge Timothy McCourt.
Charge: Perjury in unofficial proceeding, grand theft and felony fraudulent use of credit card.
Lawyers: Defending Ary is Brett Kocijan, a private attorney, and prosecuting the case is Assistant State Attorney James Moody.
Reason for court? At the Sept. 8 hearing, it was announced that charges had been filed against Ary.
What's next? Is Ary in or out of jail? Ary, who has been released on bond, has a pre-trial hearing set for November.
About the case: Ary is accused of using a credit card belonging to the city of Dunnellon to pay for a camp. He was fired from his job at the city, where he was the community development director.
