A woman accused in the death of her infantson agreed to resolve her criminal case with a plea bargain.
Here's what we know about that and one other case heard at the Marion County Judicial Center the week of Sept. 28:
State v. Kacy Joan Kincaid
Judge: Circuit Judge Barbara Kissner Kwatkosky.
Lawyers: Defense lawyer David Mengers and Assistant State Attorney Janine Nixon.
Charge: Aggravated manslaughter of a child.
About the case: Kincaid, 36, was arrested after her 10-month-old son, Kaiel, died from a drug overdose in October 2023 at a local hospital, according to law enforcement.
Kaiel's death was ruled a homicide after toxicology results showed the baby had several drugs — fentanyl and meth — in his body. The case was investigated by the Ocala Police Department.
When was Kincaid's
court appearance? Oct. 2 for a change of plea hearing.

What was the outcome? Kincaid pleaded no contest and was sentenced to six years in prison and 18 months of probation as part of a plea agreement.
The sentence was a downward departure from state sentencing guidelines. The lawyers explained that there was a dispute concerning the victim's cause of death. Also, the court had granted a motion to suppress physical evidence.
A second charge, possession of fentanyl, was dropped by prosecutors.
Once Kincaid completes a treatment program at Crossroads, she can apply to reduce her probation.
If the case had gone to trial and Kincaid was found guilty, she could have faced the maximum sentence of 30 years in prison.
As part of her plea deal, Kincaid also must pay fines and court costs and submit a DNA sample. She also faces a violation of probation case in Sumter County.
Kincaid has 1,088 days of credit for time spent in jail awaiting resolution of this case.
State v. Destin Lachey Delray
Judge: Circuit Judge Peter Brigham.
Lawyers: Assistant State Attorney McKall Miller and defense lawyer Jimmie Sparrow.
Charge: Travel to meet a minor after use of computer to lure child.
Reason for court? Delray entered a no contest plea on Sept. 28 and was sentenced to 30 months in prison and 30 months of probation as part of a plea deal. Delray was scheduled to go to trial the week of Sept. 28.
As part of his plea, Delray cannot have any contact with children and must register as a sexual offender. He has two days of credit for time served.
About the case: Delray, 57, was among 20 men arrested during Operation Parental Advisory in 2025. In that undercover sting, law enforcement officials pretended to be children on the internet and arrested adults accused of attempting to arrange sex.
