Why is city ordinance 6323 from 1972 not being enforced? That was my question to myCity Council representative and a whole bunch of city staff including City Manager and P&Z Director.

This resulted in getting a response from City employees Rejino and Kagan, which was that platting of the land in the 1940's and 1950's preempts Ordinance 6323

Fabian Mata points a finger while addressing the City Council about a proposed concrete batch plant. The Lubbock City Council hosted a meeting Tuesday, Aug. 25, in Citizens Tower. Among items on the agenda were public hearings to discuss the AI data center moratorium and a concrete batch plant request.

So I asked numerous city employees - what wording in the ordinance, what paragraph states this?

No one has responded at all. Then I discovered on page 13 of the Lubbock 2040document that the ordinance is still in effect, just " not being used."

In scrutinizing the businesses - complaints, open record et cetera - I concluded that wealthy powerful businesses on the rim of the Canyon are untouchable.

The McDougal's

and obviously PBM Concrete are partly responsible for the Ordinance "not being used." After years of operating there. Hard 8 Materials just put up their sign. Before that Bedrock Crushing.

Mountains of recycled concrete to be used as bedding for concrete slabs. Future data centers?

TCEQ is also in cahoots with the untouchables.

The numerous buildings out there - 401 and 501 N Ave. K - don't have Certificates of Occupancy, because it would require putting up enclosures of stockpiles, fencing, landscaping and parking.

These requirements are specific to the Yellowhouse Canyon Policy Zone - aka 6323.

The policy zone area is vast and if had been "used" there may not have been a need to hire outside consultants to advise.

Wasting taxpayers' money. Polluting valuable natural resources.

Well, powerful money grubbers prevail.
